Tragedy and Resistance: A Brief History of the United States

I’ve been thinking a lot the last few months about the concept of tragedy: what it obscures, and what it reveals. The United States and the world have been suffering the natural disaster of Covid-19, but the US is also suffering from the effects of unnatural tragedies, the inevitable results of lethal, racist mechanisms which were designed at the outset of the American experiment.

Three episodes in American history are particularly pertinent for understanding the new movement emerging in the streets and fighting for the freedom of people of color: slavery, the attempted Reconstruction of the rebellious South, including the original Populist movement of the 1880s and 1890s, and the civil rights movement of the 1960s. Since, as William Faulkner once put it, the past isn’t ever dead—it isn’t even past—these chapters of American history deserve another look to see what we can learn about these tempestuous times and what lies ahead.

Origins

The United States was founded on stolen soil, watered with the blood of indigenous people, cultivated with the blood of slaves who were brutally uprooted from their African homelands. Their labors, without remuneration or recognition, literally built the United States. Numerous rapacious Wall Street banks—financial institutions which exist to this day—owned slaves or invested in Southern plantations. Centuries of pain and suffering connect present and past in a chain of exploitation. The work and degradation of people of color were and continue to be the engine that generates wealth in the richest, most powerful country in human history.

Slavery was a barbaric, totalitarian system. Families were ripped apart without an afterthought. Slaveowners brutally repressed the slaves’ African culture. Slaveowners abused slaves without shame or legal repercussions. Slaves couldn’t receive an education or even the most fundamental human rights. Of course, contrary to popular textbooks that distort the historical record and submerge the history of resistance, the slaves weren’t merely victims resigned to their unenviable fate. Resistance against the dictatorship of the slaveowners could always be found: according to some research, over 250 rebellions with more than ten participants took place during the era of slavery, including Nat Turner’s famed rebellion. Despite these valiant efforts, slavery was deeply rooted and persisted for over three centuries from its beginnings in the 16th century until the emancipation of the last slaves on June 19, 1865, nowadays commemorated as Juneteenth.

It’s worth emphasizing the bare facts—it’s easy to avoid confronting the full horror of American history by hiding behind the 150+ years that separate us from slavery. Millions and millions of people were born, lived, and died under a regime that was a hell on earth. This system lasted for longer than the time that distances 2020 from the end of slavery in 1865. The evil that this system fed, created, and unleashed changed America’s character irrevocably. Its consequences ramified and multiplied over time. They corrupt the present and threaten our future. Despite all this, many white people still don’t have courage to face the facts. To understand why, we have to delve into how exactly the Civil War concluded.

The Failed Reconstruction of the South

After four long years of internecine bloodshed, on April 9, 1865, the Civil War ended. Over 1.75 million people had died. Large parts of the South, in particular the farms of Georgia, had been devastated. The main cities of the South were destroyed, reduced to ashes. It was an opportune moment for a complete transformation, one which would have realized the unfulfilled dream of freedom for all, especially in a South that was basically feudal.

At the outset, it looked like the Radical Republicans, encouraged by the Union’s victory, would be willing to do everything necessary to impose a revolution on a defeated yet resistant South. The Radical Republicans wanted to bring the full emancipation of former slaves to completion: they wanted people of color to be able to obtain all their civil rights, including the vote, and they were ready to exterminate Confederate racism and chauvinism as soon as possible. They believed in complete equality between the races.

To achieve this program, the Radical Republicans advocated the empowerment of a comparatively weak, underdeveloped federal government. This position was the perfect antithesis of the Confederate philosophy of “states’ rights.” The Republicans created the Freedmen’s Bureau to provide benefits to emancipated people and help them navigate the new world of the labor market now that slavery had been abolished. Some white allies moved to the South to teach and train freed people of color. Congressional Republicans drafted a civil rights law and expected a simple process of approval.

Unfortunately, things wouldn’t prove quite so easy. Andrew Johnson, Lincoln’s successor, was highly conservative. He opposed land redistribution to people of color and vetoed the initial, moderate civil rights law, saying that he sympathized with African-Americans but couldn’t accept the expansion of federal power that would be necessary to implement the law. He claimed it was unconstitutional. In the South, an enormous wave of resistance arose—the KKK tried to use a campaign of terrorism and violence to maintain the antebellum racial order, and many people of color perished at the hands of unrepetant white supremacists.

In the end, the Republicans forced the ratification of the Thirteenth, Fourteenth, and Fifteenth Amendments. The Thirteenth Amendment had an enormous, tragic gap—it says “Neither slavery nor involuntary servitude, except as a punishment for crime whereof the party shall have been duly convicted, shall exist within the United States”—which nows serves as a legal justification for the system of slavery that exists in prisons and jails. Today, many prisoners are forced to work for less than a dollar per hour. The Republicans also impeached President Johnson. After Johnson’s impeachment, they passed the Acts of Reconstruction, placing the South under military control. 20,000 soldiers were dispatched to the South. The military governors protected the rights of recently freed people—they helped freedpeople exercise their rights by registering Black voters and supervising elections to prevent disenfranchisement. The soldiers also paralyzed the KKK: the military governments prosecuted KKK leaders and frustrated their plots to defend white supremacy. Liberal political coalitions formed in the South, based on the support of the occupying forces, the influx of Northerners who supported racial equality, and the new political role that Black people were playing. Meanwhile, President Grant, a Republican, worked to expand the federal government’s powers to ensure Southern compliance with the law. For a moment, it seemed that this method of securing racial justice might just work.

Sadly, this glimmer of hope didn’t last. With the passage of time, political will in the North diminished; keeping the South under control through military occupation no longer seemed as appealing to many Northern whites. Resistance to Reconstruction wasn’t only a question of Southern opposition: it also stemmed from deep-rooted Northern racism. In the presidential election of 1876, the precarious political coalitions that had kept Reconstruction intact collapsed. The election was very close, and nobody knew who’d truly prevailed. The Democratic Party exploited the opportunity this electoral chaos presented: it agreed to give the presidency to the Republican Party in exchange for the end of Reconstruction and the withdrawal of all federal soldiers from the South.

After federal forces withdrew, Southern whites seized control of state and local governments. In one notable instance in Wilmington, North Carolina in 1898, they staged a coup. Then, exploiting Northern exhaustion and fading interest, they passed discriminatory laws to deprive people of color of their rights. Although Black people enjoyed their legitimate rights for a brief period during Reconstruction, the exercise of those rights was dependent on active protection from the federal government, which had an expiration date. During that short-lived period, people of color were unfortunately unable to take control of the land, tools, and money that they needed to start new lives with true freedom. Because Black people lacked capital and economic power, during the era following Reconstruction, white plantation owners reinstituted a system very similar to slavery. The sharecropping system rivaled slavery in its brutality, and it enjoyed complete legality.

The Original Populist Movement

A new grassroots movement—the Farmers’ Alliance—sprouted up on the Great Plains after the failure of Reconstruction. It represented a revolt against unfettered capitalism and an attempt to rescue American democracy. The farmers suffered from the depredations of the great corporations of the East. They craved an end to monopoly power and Wall Street oligarchy. They developed a clear program with well-defined demands, all based on a major expansion of the regulatory powers of the federal government: land reform, progressive taxation, the nationalization of the banking sector, the nationalization of railways and telecommunications, the establishment of postal banks, and recognition of workers’ right to unionize. To achieve these goals, the Alliance organized demonstrations with bands and parades.

The Alliance’s efforts met with a certain measure of success: at the beginning of 1884, its members numbered 10,000; by 1890, their ranks had blossomed to over a million. The movement began in the Great Plains, but to create a durable coalition in the US, a social movement needs a nationally distributed base of support. Then as now, the American working class and lower classes were multiracial and lived in different parts of the country. To expand their reach, the Alliance had to overcome deep-rooted interethnic and interracial divisions in the South and in the cities of the North. This proved to be particularly problematic, just as difficult as combating corporations’ fierce resistance and smashing corporate control over the political process once and for all.

Take Tom Watson, a leader of the Populist movement in his home state of Georgia, as an example. At first, he ardently defended the civil rights of people of color: he advocated for equality at the ballot box and roundly denounced lynching. But after some electoral defeats in 1896 and a mysterious psychological alteration, Watson reversed course. Around 1900, he began to attack people of color with racist vitriol. Watson’s abrupt shift symbolized the Populists’ predicament. Confronted with irredentist, revanchist politics and a campaign of terror by racist paramilitary groups, the Populist movement hesitated—and that was the definitive end to Reconstruction and the promise of social democracy in the United States at the end of the 19th century.

The 1960s and a Frustrated Mass Movement

Fast forward six decades. The segregation regime in the South had endured, codified in state laws and daily practices. Unionization campaigns in the South in the 1940s and 1950s, including the CIO’s Operation Dixie, had failed, unable to surmount ingrained racism. But finally a well-coordinated movement, with capable leaders; a ready, determined rank and file; and decades of preparation, was on the march.

At first, the civil rights movement encountered resistance in the field of public opinion. In May 1961, 57% of people believed that demonstrations in the South (sit-ins, Freedom Buses, etc.) would harm the cause of desegregation. Even as late as May 1964, after many protests, 74% of people believed that mass demonstrations by people of color would damage racial equality. Only in the end of the 1960s, after five years of marches, and with the specter of violence hanging in the air, did public opinion finally change: in May of 1969, 63% of people believed that nonviolent protests could achieve racial equality.

How this change of heart occurred—and how the civil rights movement evolved during the 1960s—is instructive. Initially, and with good reason, reflecting the most pressing problems, it focused principally on liberal, formal equality: the right to desegregated public facilities, the right to vote without reprisals, the right to attend integrated schools, the right to be protected from labor discrimnation. Public demonstrations unquestionably succeeded, creating the push necessary for the federal government to act: LBJ didn’t have any other option but to take decisive legislative action to make racial equality more than empty words.

But Martin Luther King, Jr., and other leaders of the movement, including the queer democratic socialist Bayard Rustin, recognized that civil rights don’t count for much without complementary economic and social rights. King asked, referring to the sit-ins, “What good is having the right to sit at a lunch counter if you can’t afford to buy a hamburger?” In the years before his assassination, King began to pay attention to the need for sweeping structural changes to the economy. He was assassinated in the midst of a visit to Memphis to support a sanitary workers’ strike.

King was organizing a Poor People’s March in 1968 to win universal economic and human rights. King and other leaders of the movement wanted to unify poor whites, Native Americans, Chicanos, Black people, and other marginalized groups into a powerful coalition capable of transforming the United States into a humane nation, with democratic socialism for all and militarism and imperialism for none. The Black Panthers and other radical Black Power organizations emphasized separatist elements of Black empowerment in some cases, but they always underlined the importance of socialism and anti-imperialism in winning genuine liberty. Radical groups like the Black Panthers also operated social programs in their own communities, offering a grassroots model for social change.

Sadly, the spate of assassinations in the middle and late 1960s of leaders on the Left like MLK, RFK, Malcolm X, and Fred Hampton, coupled with the bloody war in Vietnam, conspired to deflate the movement. Although the Poor People’s March still took place, it didn’t receive the attention it deserved, and the dreams of a more just country and world bled nearly to death, victims of the Cold War and violent reaction spearheaded by Richard Nixon, Ronald Reagan, and the Republican Party. Instead of resisting this regression, the Democratic Party establishment united with the Republicans during the 1980s and 1990s to pass laws which spawned a grotesque system of mass incarceration and out-of-control policing, hiding behind anti-crime slogans. Meanwhile, the history of imperialism and interventionism that has destroyed the lives of people of color worldwide continued to unfold.

The Present

What lessons do these episodes of American history suggest for us today?

Firstly, the fight for the right to vote—and for the civic equality that it represents—has always been central in the struggle for racial justice: from the beginning, during Reconstruction, the Populist movement, and the civil rights movement. A common thread that connects American history is the elite attempt to limit the electorate—only by doing so can elites maintain their fidelity to the idea of formal democracy. The moment the electorate turns into a threat against racist and capitalist power, elites have always been willing to jettison their ostensible love for democracy, even going so far as to use terrorist violence to repress people of color.

Secondly, and probably more importantly, Reconstruction never attempted to correct economic injustice and the racial power imbalance. Former slaves were converted—against their will—into workers ready to enter the new labor market that the capitalists had instituted in the “reconstructed” South. Ex-slaves won neither reparations nor control over capital and the economic conditions that structured their lives. Congress didn’t pass land reform. The Thirteenth Amendment didn’t even abolish slavery completely. Reconstruction’s failure to change material conditions in the South and elsewhere was its weakest point. One might even say that the Civil War never truly concluded: we never successfully quashed the Confederacy’s racism and feudalism.

Defeated outright on the battlefield, the Confederacy switched tactics, transferring its hatred and opposition towards American state-building and national consolidation to new vessels: reactionary Republicans and Dixiecrats, paramilitary campaigns of racial terrorism, and white supremacist groups like the KKK. The battle between federal power and “states’ rights” has always had racial implications. “States’ rights” acts as a mask, a euphemistic facade, to preserve white supremacy. Where exactly the conflict between the federal government and local legislatures stands is a good indicator of the status of civil rights nationwide at any given moment in American history, with the shameful history of HUD redlining and the Trump administration’s Department of Justice serving as prominent exceptions to this tendency.

The sad collapse of the Populist movement shows us how racism has functioned as a weapon against grassroots movements. Racial tensions are a major obstacle that discourage unity among oppressed groups, even though marginalized groups share many of the same interests. As the author Isabel Wilkerson suggests in an extraordinary article (and in her new book), we should regard the United States’ racial system as a caste system akin to the one in India.

The civil rights movement’s experience shows us that protests can get results. On their own, they can change public opinion—certainly not overnight, but gradually. More importantly, they can force legislative changes. Those changes tend to persuade people more effectively and efficiently than almost anything else. The civil rights movement’s ultimate collapse in the late 1960s and early 1970s was a question of bad luck: the assassinations of MLK, Malcolm X, Robert Kennedy, and Fred Hampton effectively arrested the momentum of the movement’s radical and mainstream wings alike, as did the disaster in Vietnam.

The history of the civil rights and Populist movements also underscores the connection between the struggle for racial equality and the struggle for democratic socialism: a dialectical relationship exists between particular demands and universal demands. For tactical and moral reasons, in a country with a multicultural, multiracial working class, one must construct a coalition that unifies different groups to have the possibility of overthrowing a potent, united corporate elite.

An internationalist analysis is essential: the role that the US has played on the international stage is inseparable from our domestic situation. In other words, America’s racism against its own citizens and its racism against people of color in countries around the world are inextricably linked. Exactly for that reason, before he died, King began to fiercely critique the war in Vietnam, denouncing militarism, materialism, and imperialism as deadly triplets linked with racism, and warning that the United States was risking “spiritual death.” The inevitable consequence of a system that devalues the lives of a large part of its own people is that its disdain for humanity will infect every cell of the body politic, internally and externally.

We’ve seen this truth manifest disturbingly in Portland and other parts of the US, where federal troops have sought to repress protests using violent, illegal tactics. To safeguard white supremacy, Trump and his flunkies have seemed willing to impose all-out authoritarianism on American soil, a marked difference from the history of American imperialism, which ordinarily preserves some degree of separation between conditions in the imperial metropole and conditions in the periphery. If we cross that Rubicon, it won’t be a coincidence that the lurch into outright authoritarianism will have a great deal to do with racism. Nor was it a coincidence that federal troops used the arms and authority that the War on Terrorism, a war which has been a catastrophe for people of color in the global South, has given them.

But there are also some promising signs. The protests we’ve been witnessing have lasted a considerable amount of time, and a broad coalition appears to be forming to support the protesters. Although the vast majority of the protesters’ policy agenda hasn’t been realized yet, popular awareness of the urgent need for racial justice has risen rapidly. The deplorable economic situation in which we find ourselves also offers us an opportunity to mobilize the people to fight for economic justice. Also promising is the energy we felt on the streets this summer. Although it’s tempting to surrender in the face of all the formidable obstacles we face, the protesters appear committed, come what may.

American history is tragic. This chapter isn’t an exception: the extrajudicial execution of George Floyd by the police was particularly horrific. Even so, Floyd’s murder was yet another in an appallingly long list of similar murders. The implication of the term “tragedy” is that we can neither avoid nor change our fate. Fortunately, the protesters have demonstrated, in spite of everything, that they still believe our destiny can be changed.

Uprising, Counterinsurgency, and Civil War: Understanding the Rise of the Paramilitary Right

The bulk of this text was composed in September and October 2020, when the George Floyd uprising was still unfolding and many people feared that Trump would try to hold on to the presidency by any means necessary. Since then, the uprising has lost momentum and the Trump administration has failed to organize a seizure of power.

Yet the dynamics described herein persist. The uprising remains latent, waiting to re-emerge onto the streets, while the formation of a new MAGA coalition is underway. Since the election, a constellation including the pro-Trump right, conspiracy theorists, the remnants of the alt-right, and traditional white nationalist groups has formed around a belated attempt to keep Trump in power.

This coalition is motivated by conspiracy theories and narratives about Democrats “stealing” the election. An additional segment of the American voting population has connected with the far right, openly calling for their opponents to be eliminated by violent means. This is not just a new right-wing coalition, but a force with the ability to leverage AM radio, cable news, and elected officials to spread racism, xenophobia, and weaponized disinformation.

Trump and his supporters will be removed from office shortly, but this coalition will persist for years to come. While centrist media outlets described Trump as seeking to seize power, his supporters see themselves as acting to defend the “real” America. In response to Trump’s removal from power, they aim to work with the “loyal” elements of the state—chiefly right-wing politicians and police—to eliminate what they consider an internal threat to the US political project. At its foundation, the right remains a force of counterinsurgency.

Introduction

The events of the George Floyd uprising represent something fundamentally different from the convulsions of the preceding twenty years. The normalities of activism, the structures of discursive engagement premised on dialogue with the state, gave way; their hegemony over political action began to crumble before our eyes. The mass mobilizations—with their staid, boring formats, their pacifist actions with no plan for escalation, their constant repetition of the same faces in the same groups—were replaced by a young, radical crowd largely comprised of people of color, willing not only to challenge the state, but also to fight back. Over a period of months, the previous barriers of political identity evaporated—the constructs that distinguished “activism” from “normal life.” This new force ripped open the streets themselves, leaving the shells of burned police cars in its wake.

For some of us, this was a long time coming. The global influence of the US has been in decline since the end of the Cold War; the post-political era that Fukuyama and Clinton proclaimed so confidently has given way to a history that continues to unfold unstoppably. The war that the police wage against us every day finally became a struggle with more than one antagonist. The long anticipated uprising, the moment of reckoning with the bloody past of the American political project, seemed to be at hand. We saw the state beginning to fray at the edges, losing its capacity to maintain control. While we cannot yet see a light at the end, we have at least finally entered the tunnel—the trajectory that will lead us towards the conflicts that will prove decisive.

But, just as quickly as this new momentum emerged, we were immediately beset on all sides by the forces of counterinsurgency. The logic of the revolt is constantly under attack, sometimes by those we had counted as allies. Some insist that we must present clear reformist demands, while others aim simply to eliminate us. All the techniques at the disposal of the state and its attendant political classes—including those within the so-called movement—are engaged as our adversaries endeavor to capture the energy of the struggle or exploit it for their own gain.

From the first days, liberal organizers played a core role in this attempt to bring the revolt back within the structures of governance. Caught off guard, they immediately began a campaign to delegitimize the violence expressed in the streets by framing it as the work of provocateurs and “outside agitators.” They progressed to trying to capture the momentum and discourse of the movement, forcing the discussion about how to destroy the police back into a discussion about budgets and electoral politics. Now, as Joe Biden gets his footing, liberals have completed this trajectory, arguing that rioting is not a form of “protest” and that the full weight of the state should be brought to bear on those who stepped outside of the limits of state-mediated politics.

The truth is that the revolts of 2020 represent a direct response to the failures of former attempts at liberal capture. During the uprisings of 2014 and 2015, liberals were able to seize control and force the discussion back to the subject of police reform. Consent decrees were implemented across the country; so-called community policing (a euphemism for using the community to assist the police in attacking it) and promises of legislative reform effectively drove a wedge between militants and activists. These attempts delayed the inevitable explosions that we have witnessed since the murder of George Floyd, but they were stopgap measures bound to fail. The current revolt confirms that reformism has not addressed the problem of policing. The areas of the country that have seen the most violent clashes are almost all cities run by Democrats, in which reform was tried and failed. In some ways, the narrative advanced by the Trump campaign that cities are in revolt due to Democratic administrations is true—but it is not as a consequence of their permissiveness, but rather of the failure of their attempt to co-opt the energy of revolt.

At the same time, we are experiencing a new attempt to supplement state forces with the forces of the far right. Militia groups that previously claimed to be opposed to government repression are now mobilizing their own informal counterinsurgency campaigns. This is not surprising, given that these militias were always grounded in preserving white supremacy. It is also unsurprising that more traditional Republicans have allowed themselves to be pulled in this direction—ever since September 11, 2001, their entire ethos has been built around the idea that they are the only people willing to defend the “homeland” from outside threats.

Yet it is surprising the lengths to which the state is willing to go to accomplish this goal. Traditionally, the basis of the state has been a set of logistical forces able to impose the will of a sovereign; in America, that sovereign is liberal democracy itself. The continuation of this project is directly tied to the state’s ability to function in space, logistically and tactically; this requires spaces to be “smooth,” predictable, and without resistance or escalation, both of which can cause contingent effects that disrupt state actors’ ability to predict dynamics and deploy accordingly. In calling for para-state forces to confront the forces of revolt in the street, Trump and his colleagues are setting the stage for a conflagration that—if all sides embrace it—could lead to large-scale social conflict. Their willingness to embrace such a risky strategy suggests how near the state has been pushed to losing control. It also indicates the ways that they are willing to modify their counterinsurgency strategy.

The revolt is now under siege. The official state forces—the police, federal forces, National Guard, and the like—are employing a strategy of consistent escalation, which functions both as retaliation and repression. The forces of liberal capture have showed which side they are on, affirming Biden’s promise to crush the militant sectors of the uprising and reward the moderate elements. The forces of the right have received approval to generalize the “strategy of tension” approach that they developed in Portland in the years since 2016. When these newly anointed forces of right-wing reactionary para-militarism are incorporated into an already existing patchwork of counterinsurgency-based approaches, the scene is set for a scenario that can only end in mass repression or mass resistance, and likely both.

The emergence of these converging counterinsurgency strategies has coincided with a rising discourse of civil war. This is not the sort of civil war discussed in texts like Tiqqun’s Introduction to Civil War, which describes, in hyperbolic terms, a conflict between different “forms of life.” Civil war, as understood in the modern US context, is a widespread frontal conflict between social forces that involves the participation of the state but also takes place apart from it. The idea that this could somehow resolve the core social and political differences emerges from a millenarian vision structured around American civilian militarization, which has emerged in response to the so-called “War on Terrorism,” the realities of social division within the US, and the rising perception of threats, whether real (people of color dealing with the police) or imaginary (“rioters are coming to burn the suburbs”). Though many on all sides embrace this concept, this fundamentally shifts our understandings of strategy, politics, and the conflict itself.

We should be cautious about embracing this concept of civil war; we should seek to understand the implications first. The framework of civil war might feel like an accurate way to describe our situation. It can feel cathartic to use this term to describe a situation that has become so tense. But embracing this concept and basing our mode of engagement on it could unleash dynamics that would not only put us in a profoundly disadvantageous situation, tactically speaking, but could also threaten to destroy the gains of the uprising itself.

Before we can delve into why this is the case, we must review how the framework itself emerged. To do so, we need to go back to the middle of the 20th century.

The Origins of the Push towards Civil War

To consider what civil war could mean in contemporary America, we have to understand how we got here. We have to tell the story of how white supremacy shifted from being identical with the functioning of the state itself to become a quality that distinguishes the vigilante from the state, on a formal level, while operating directly in concert with the state. What we are tracing here is not a history, in the sense of a chronicle of past events, but rather a sort of genealogy of concepts and frameworks.

We’ll start with the shift in political and social dynamics that took place in the late 1950s and early 1960s in response to the Civil Rights Movement. Resistance to hegemonic white power began to impact two fundamental elements of white American life during this period: the concept of American exceptionalism—the idea that America is a uniquely just expression of universal human values—and the notion of a hegemonic white power structure. This led to a shift in the ways that white, conservative groups viewed the world. They felt their hegemony to be newly under threat, not only in regard to their control of political institutions, but also in ways that could erode their economic and social power.

Previously, in many places, police had worked hand in hand with vigilante groups like the KKK to maintain racial apartheid. The day-to-day work of maintaining this political structure was largely carried out by official forces, with the underlying social and economic support of a large part of the white population. For example, during the racist massacre that took place in Tulsa, Oklahoma in 1921, many of the white assailants were deputized and given weapons by city officials.

During the fight for civil rights in the 1960s, when the role of the state in the enforcement of white supremacy began to shift in some places, many white residents adopted an active rather than passive posture in supporting the racist aspects of the social order. As resistance reached a critical mass, the issue of racial segregation became openly political, rather than unspoken and implicit, with entire political platforms structured around positions regarding it. In response to the challenge to the hegemony of the white apartheid state, the structure of apartheid came to the surface, and white Southerners enlisted in openly racist political forces on a scale not seen since at least the 1930s. These shifts and the subsequent widespread social response created the political and social conditions for the dynamics we see today.

During that period, the discourse of white supremacy also changed form. As oppressed populations rose up with increasing militancy, the narrative of unchallenged white supremacy gave way to a new narrative grounded in an idyllic portrayal of white Christian America and a promise to construct racial and economic unity around an effort to regain power and restore the “lost” America. This narrative, articulated by politicians like George Wallace, Barry Goldwater, Pat Buchanan, and later Ronald Reagan (and distilled today in Trump’s slogan “Make America Great Again”), was not just a call to preserve white supremacy. Rather, it described an ontological conflict in which the attempt to overthrow Jim Crow and bring an end to structural disparities represented a threat not only to an economic and social structure, but also to white America itself. Further, it proposed that this threat necessitated a response employing informal violence, mobilized across a wide swath of society, with the consent of the state. This narrative portrayed the emerging social conflict, not as a conflict about race and politics, but as an existential struggle, a matter of life and death.

In some circles, the demand for a political and social unity for white America was framed in terms of “civilization”—this is the current from which the contemporary far right emerged. As Leonard Zeskind argues, this shift involved embracing the concepts of “Western civilization,” the need to defend it, and the incorporation of fascist and Nazi tropes into the thinking of the far right. Many of the personalities who were to drive a militant shift in the far right—David Duke, Willis Carto, William Pierce, and others like them—began to publish newsletters and books, finding a home in the world of gun shows and obscure radio programs. This shift, from white populations taking their political and social domination for granted to white populations reacting to a perceived loss of hegemony, also contributed to the rise of armed right-wing groups. The idea of defending Western civilization provided a moralistic framework and a justification for violence, leading to groups like The Order carrying out armed robberies and assassinations during the 1970s and 1980s.

In more mainstream Republican circles, these ideas of the idyllic America and its civilizational superiority became policy positions, though they were expressed only in coded terms. By the time of the 1992 George HW Bush re-election campaign, it was no longer possible to leverage overt racism within polite society the way it had previously been. As a result, the right began to frame this discourse in new terms, speaking of “Western” values and civilization, describing a “real” America defending the world against Communism and disorder, which were implicitly associated with racial and political difference. In place of people like Duke or Wallace articulating overt calls for racial segregation, the right began to use a different discourse to call for separation on the basis of the concepts of purity and deviance and the language of law and order.

This served to define a cultural and political space and also the areas of exclusion—not on the basis of overt concepts of race, but around the idea of a civilizational difference. The terms of division were sometimes framed through the lens of religious differences, other times through the lens of a gulf between a rural and an “urban” America. Some within the right at this time, like Lee Atwater, discussed this shift overtly with their supporters (though behind closed doors), articulating how “dog whistle” policies on tax, housing, and crime could serve as replacements for the overt racism of the past. This concept of a Western civilization under threat fused with the fervor against “communism” that was revived under Reagan in the 1980s, along with rising conspiracy theory discourse—a toxic mixture that would explode, literally and figuratively, in the late 1980s.

Meanwhile, the rise of the religious right as a political force added another element to this fusion of conspiracy theories, anti-communist paranoia, and the increasingly armed politics of white grievance. Prior to the Reagan campaign in 1980, the religious right had largely approached politics with suspicion, with some pastors telling their parishioners not to participate in a political system that was dirty and sinful. The Reagan campaign intentionally reached out to this segment of the population, shifting its campaign rhetoric to attract their support and elevating their concerns into the realm of policy. Consequently, anti-choice campaigns and the like became a powerful means to mobilize people. This gave the narrative of social polarization an additional moral and religious angle, using rhetoric about sin and preventing “depravity.” The result was an escalation into armed violence, with the Army of God murdering doctors and bombing abortion clinics around the US.

In this move toward armed violence, right-wing terrorist discourse underwent a few modifications. The first of these was an expansion of the terrain where they saw the “war” being fought. The tendency towards armed violence expanded from focusing on civil rights initiatives and the question of whether marginalized groups should be able to participate in society to sectors that had traditionally considered themselves distinct from overt fascism. As the mainstream right increasingly embraced the concept of the culture wars, they also adopted the implication that there was a fundamental existential conflict. By framing the conflict in terms of purity and deviance, coupled with the idea of civilizational conflict that was already emerging in the right, the construction of an absolute social division around political power came to justify a rising discourse of armed politics. Right-wing attention was concentrated on those who did not share right-wing moral codes; this was framed as a justification to use state violence (in the form of legal restrictions, such as abortion bans) and armed force (in the form of far-right terrorism) to eliminate all groups perceived as threats to moral American life.

In addition to targeting people who were pro-choice, who had different religious affiliations, or who expressed themselves outside of the cis-hetero normative construct, these perceived threats were also directed at non-white people, though this was framed in the language of responding to social and political deviance. The idea of an armed cultural conflict, the targets of which now included everyone outside of white Christian conservatism, began to spread throughout the right wing, as some of the more moderate factions embraced or at least explained away anti-choice violence or the formation of militia groups. However, as the violence became a more significant political liability, conservative politicians began to modify the extremist rhetoric of armed factions into policy, embracing the culture of these political circles while rejecting armed violence, at least in public. This was evident in anti-choice politics, in which politicians embraced groups like Right to Life but rejected groups like the Army of God even as they incorporated their political rhetoric into policy.

The development of this broad political identity based in white Christianity and the attempt to restore and protect an idyllic America from all “outside forces” brought the discourse of far-right organizations into increasingly mainstream contexts starting in the early 1990s. However, while their ideas were becoming more and more generalized, armed far-right groups became increasingly isolated, especially as the Gulf War precipitated rising mainstream patriotism. As allegiance to the state became a default politics on the right, armed violence was increasingly seen as fringe terrorism. In some ways, during this period, the right no longer needed the armed groups, since it held almost unchallenged power, and could implement far-right visions incrementally through policy.

During this period of right-wing ascendancy and lasting until the election of Clinton in 1992, the armed far right became publicly ostracized from the mainstream right, which increasingly saw the indiscretion of the far-right as a liability. Increasingly marginalized, far-right fringe elements kept to themselves, breeding an ecosystem of conspiracy theories dispersed via newsletters, pamphlets, books, and radio. However, with the rise of the Clinton administration and the loss of Republican power in Congress, far-right beliefs were slowly reintegrated into the mainstream right. Publications like American Spectator magazine picked up fringe conspiracy theories from the far right about the Clintons’ financial dealings, the deaths of their former friends and business associates, and Bill Clinton’s supposed ties to moderate left-wing activists during the Vietnam War (never mind that he was an informant while at Oxford). This process accelerated after the government raids at Waco, which were portrayed by many on the right as an attack against a religious community over gun ownership issues, and at Ruby Ridge, portrayed as a state assault on a rural family minding their own business.

The events that played out at Waco and Ruby Ridge, early in the Clinton administration, began to play a role of being points of condensation around which conspiracy theories could form. The efforts to establish global unity under American political norms, which arose at the end of the Cold War, accelerated the emergence of narratives about a purported New World Order—a superficially modified version of some of the anti-Semitic conspiracy theories that the Nazis had previously advanced. Combined with the narrative of an absolute cultural and political division, this fueled perceptions that the “traditional” America that the right wing held up as an ideal was collapsing. Elements of the racist far-right used these conspiracy theories as openings to enter mainstream right wing circles. Mainstream Republican discourse integrated the former fringes—a move propelled by Newt Gingrich and Thomas DeLay for the purposes of creating a permanent Republican voting block; by pushing the narrative of permanent division and existential threat, they could demonize the Democrats, guaranteeing loyalty among their voters. The popularization of these narratives extended the Overton window to the right in ways that the far-right subsequently exploited to extend its influence and recruitment. Many of these tendencies fuel present-day Trumpism.

Concurrently, in the 1990s, militia movements that had previously been viewed as fringe elements increasingly came to be regarded as necessary to defend America from internal and external enemies. As right-wing conspiracy theories reached a fever pitch and increasingly mainstream Republicans embraced these politics, the militias grew in size. This tendency, coupled with the right’s historic fervor for gun culture, popularized the notion of the “patriot” standing up against “tyranny” to preserve “freedom” and an American (read: white-dominated) way of life. This language was continuously weaponized over the following decades, pulling more moderate conservatives into contact with extreme right-wing ideas, which became less and less divergent from the language of mainstream Republican activists.

Understandings of “freedom” as the preservation of white domination and Christian supremacy continued to infiltrate the mainstream right, fueled by the conspiracy theories about how Clinton was going to destroy the white Christian way of life in America. In this mutation, the concept of “freedom” was modified to represent a rigid set of social norms. For example, Christian groups began to declare that it was a violation of their “freedom” for the state to allow non-hetero couples to marry, or not to force children to pray in school. In the past 30 years, this dynamic has been repeatedly applied to exclude people from society based on sexual orientation or gender identity and to further integrate the language of Christianity into government documents. This notion of “freedom” as the “preservation” of a “way of life” has become so popular with the right-wing that it barely requires repeating when politicians employ it to push policies of exclusion. Combined with the desire to eliminate difference and to preserve social and political inequality, disempowerment, and racial apartheid, the notion of “freedom” has been stripped of any actual meaning. This has set the stage for an increasingly authoritarian posture across the right.

The concept of a culture war, which had become common parlance within the religious right, fused with the widespread conspiracy theory narrative describing the rise of a tyrannical elite. In its attempts to undercut Clinton, the Republican Party created the conditions for a concept of total cultural warfare, which became increasingly militarized and seeped back into the more moderate factions of the Republican Party. Some of these factions still embraced policy-centric positions, but the narratives they utilized to motivate voters were all based on this notion of an absolute cultural threat. Voters were presented en masse with the image of an American culture threatened with extinction, led to believe that they were the only forces that could mobilize against a tyrannical “liberal elite” in order to preserve their “freedom.” As this mentality generalized, the idea of civil war as a horizontal conflict between social factions came to be widely accepted among the right.

The Mentality of Defending the “Homeland”

With the advent of the second Bush administration and the September 11 attacks, the relationship between the state and the fringe far right changed dramatically. The state’s response focused on constructing a national consensus around the “War on Terrorism”—a consensus which was exploited to justify systematic violations of civil liberties, to target entire communities, and to channel trillions into overseas military occupations. The core of this campaign was the construction of a narrative of two elements in conflict (“with us or against us”)—a binary distinction grounded in unquestioning loyalty to the state—and the drafting of the “public” into the intelligence and counter-terrorism apparatuses. The attacks themselves and the rhetoric around them helped to popularize the concept of a conflict of civilizations; the idea of defending the “homeland” from foreign threats that sought to “destroy the American way of life” was increasingly adopted across the American political landscape. A sort of renaissance occurred in the militia movement: no longer alienated from the state, the militia movement started to become a cultural phenomenon. The concept of the citizen defender of the “homeland” entered popular culture, becoming a widespread cultural archetype within mainstream conservatism.

The embrace of the tenets that formed the foundations of the militia movement in the decade leading up to September 11 had profound effects.

First, an ecosystem of conspiracy theories developed around September 11, propelling Alex Jones from the fringe towards mainstream conservative circles. This was bolstered by state efforts to spread the narrative that hidden enemies within the US were waiting for a time to attack. This posture lends itself to justifying social exclusion and validating conspiracy theories; the threat is not apparent but hidden, associated with elements of society that diverge from supposed social norms. As a result, the narrative on the far-right shifted from a framework that was at odds with the state to a framework in which the right targeted others based on race, religion, and politics in order to defend the state itself. Conspiracy theorists were able to exploit increasing Internet use, using online media and the newly formed mass social media platforms—chiefly Facebook—to spread conspiracy theories to new social circles.

Second, the incorporation of far-right ideas and personalities into mainstream conservative discourse brought more traditional conservatives into increasingly close contact with extreme racism and Islamophobia. Before the rise of social media and the right-wing idea of the civilian soldier, many people saw these conspiracy theories as marginal and lacking credibility, or else did not encounter them in the first place. But now, these fringe elements gained an audience within more mainstream circles, hiding their intentions within the parlance of counter-terrorism. As the field of counter-terrorism studies emerged, many of those who initially populated that world hailed from the Islamophobic far right; they were able to pass themselves off as “terrorism experts” simply by presenting themselves as a “think tank” and making business cards. As the right came to adopt the concept of an absolute threat and to identify that threat with otherness in general, the fear of an immediate terrorist threat that politicians had propagated bled over into cultural and political divisions, conveying the sense that the enemy represented an immediate and physical threat to health and safety. The more this mentality spread throughout the right, and the more that this was leveraged to demonize difference, the more the conditions were created for these divisions to be characterized with a narrative of overt warfare.

For more and more Republicans, inclusion in society became conditional, depending on political beliefs; protest activity was enough to identify a person as an external enemy. This is ironic, insofar as the right wing has dishonestly sought to rebrand itself as defending free speech.

Within the right, as the idea of a militarized defense of the state against enemies both internal and external took shape, the definition of “enemy” expanded to include not just those of different cultural, ethnic, or religious backgrounds, but also immigrants, Muslims, and “liberals.” As the Bush era wore on, this newly empowered militia movement, increasingly aligned with the white nationalist agenda, began to engage in semi-sanctioned activity, such as the Minutemen patrols along the Mexican border. Republican politicians incorporated the ideals of these militarized groups into GOP policy, both nationally and locally in places like Arizona, where white nationalists played critical roles in drafting SB1070, and later helped to popularize a narrative about the need for a border wall. Following the patterns of past social conflicts, this narrative served to create political conditions that could render increasingly invasive state policies more acceptable and successful—including the expansion of the surveillance state, the militarization of the police, and the military campaigns in Afghanistan and Iraq.

As militarism took hold on the right, the foundations of the contemporary conservative position were laid. The right came to see themselves as defenders of the state, and the state as the force that defends their “freedom”—understanding “freedom” as the preservation of a white Christian conservative society. Consequently, formerly anti-government militias shifted to openly supporting repressive government intervention, and even the supposedly “libertarian” elements of the right embraced the police and the forces of the state.

When Obama took office, the stage was set for the final act, in which the politics of white grievance, the violent preservation of white supremacy, and what would become a state strategy of counterinsurgency came together in a volatile cocktail. Just as they had during the Clinton era, Republican politicians began to capitalize on racism and conspiracy theories as political strategies to regain power—but this time, these conspiracy theories took on overtly racial and religious tones. What had been implicit in the 1990s was now explicit.

The prevalence of conspiracy theories within the Republican Party reinforced the notion of a “real America” protecting the state from internal enemies—which, according to this narrative, had managed to take control of the state itself in the form of the Obama administration. The necessity of portraying the threat as Other, external to a “real America,” is obvious enough in the rise of the “birther” conspiracy. The right merged everything they opposed into a singular force attempting to destroy America: recall the infamous Glenn Beck conspiracy board, according to which the Service Employees International Union was selling copies of The Coming Insurrection to help Obama institute Islamo-Fascist Leninism. This completed the process via which the right had begun to view all who disagreed with their doctrines as the enemy and to consider themselves a distinct political project based around the defense of America.

Paranoia took over in the mainstream right. All sources of information that did not reinforce their views, all policies that could be portrayed as part of a “liberal conspiracy,” all efforts to promote social tolerance were seen as direct attacks against America itself. The conspiratorial tendency that Republicans had incorporated into the party in the late 1990s had metastasized into a belief that Republicans were constantly under assault by enemies that must be destroyed. The entirety of society and politics were viewed as the terrain of an ongoing civil war, conceptualized in increasingly millenarian terms. To those outside the right, this narrative seemed completely divorced from reality—but within these circles, these theories were the result of years of social polarization and burgeoning ideas about cultural warfare, promoted by Republican politicians. Departing from the idea of a lifestyle under threat, moving through the concept of cultural warfare into conspiracy theories and the framework of civilizational warfare, an overtly racist call to “protect Western civilization” became the cornerstone of contemporary right wing politics.

The open embracing of conspiracy theory generated several mutations within right-wing discourse, two of which became prominent.

The first mutation took the form of the Tea Party and the birther conspiracy—from which Donald Trump’s candidacy ultimately emerged. In these circles, conspiracy theories fueled by Facebook and online right-wing platforms spread at an unprecedented pace, generating theories about everything from “death panels” to undocumented immigration and eventually culminating in QAnon. The rapid pace at which these theories proliferated and were adopted by the Republican Party and their attendant media organizations, such as Fox News, created the conditions for these narratives to grow increasingly divergent from demonstrable and observable fact. In these circles, the acceptance of information had less to do with its veracity than with the declared politics of the communicator. This backlash against “liberal media”—i.e., any media organization that did not valorize right-wing narratives—formed the basis of the “fake news” narrative later pushed by Trump.

The second mutation was the emergence of newly empowered militia and white nationalist movements, which had come to exist in close proximity with one another twenty years earlier when they were relatively isolated during the Clinton era. These organizations capitalized on their newfound access to people in positions of power. Narratives about defending the state against “outsiders” continued to spread online, enabling militia groups to capitalize on populist discontent in the waning years of the Obama administration. These elements began to organize through several different channels, including attempts to carry out attacks against immigrants and Muslims, the emergence of “citizen’s militias” in places like Ferguson, Missouri in response to the uprising against racist police violence, and direct standoffs with state forces such as the one at the Bundy Ranch in 2014. These confrontations provided a point of condensation, while right-wing media pointed to them as examples of “resistance” to the supposed internal threat.

Concurrent with the acceleration of activity within conspiracy theory and militia circles was the rise of the “Alt-Right,” which emerged during “Gamer Gate” in 2014. Largely driven by the Internet and misogynist white grievance, this element introduced a new and well-funded influence into the right-wing ecosystem. The Alt-Right is rooted in the white-collar racist right-wing, populated by figures like Jared Taylor and Peter Brimlow who were often seen as soft and bourgeois by other elements of the far-right. Taylor, Brimlow, and similar figures are situated in the universities and think tanks of Washington, DC; they had always operated in a space between the official Republican Party and the Nazi skinheads and racist militias that had dominated the far-right fringe for decades. Flush with cash from tech and financial industry funders and armed with a logic of strategic deception, the Alt-Right gained widespread attention through online harassment campaigns, which they justified by disingenuously leveraging the rhetoric of free speech. Thanks to the developments of the preceding years, the Alt-Right was able to traffic openly in conspiracy theories and disinformation while portraying anyone who opposed them as part of the “liberal establishment”—the groups that the right had convinced their adherents represented an internal threat.

As the online presence of the Alt-Right grew, they gained entry into influential Republican circles by teaming up with older, more traditional racist conservatives who had attained positions from which they could shape policy. This influence was amplified by publications like Breitbart, run by Trump’s confidant Steve Bannon, and funded by the Mercer family, who made billions running hedge funds. For Republicans like the Mercers, embracing the Alt-Right was a strategy to gain power within conservative circles and overcome the power networks of more traditional funders like the Koch brothers. Others recognized the power that they could wield by tapping into the online forces assembling around the Alt-Right. This online presence was supplemented by the mobilization of older conservatives through the Tea Party, rising far-right activist energy, and the construction of a culture around the militia movement.

Many conservative politicians began to embrace this new formation, despite its outright racism and the ways it used confrontational tactics to achieve its goals. In many ways, as with Gingrich and DeLay in past decades, Republican politicians saw this new element of the right wing as a possible source from which they could draw grassroots energy. They hoped to use this energy to compensate for the fact that the Republican Party was becoming a minoritarian party with a voter base that was slowly dying out—just as they used gerrymandering and voter suppression to counteract this disadvantage. They saw an opportunity to construct a voting block that was completely loyal to them and isolated from any other perspectives, beginning with the demonization of the “liberal media” and eventually encompassing every aspect of everyday life—where people buy food and clothes, what kind of cars they drive, the music they listen to, the books they read. The social “bubble” that the right had spent years building crystalized, enabling them to mobilize rage and reactionary anger almost at will. Though this allowed the Republicans to leverage parliamentary procedure to limit much of the Obama agenda, it also created the conditions that led to the old guard of the party losing control over the party itself.

Out of this moment arose Donald Trump, who ran a campaign that was as openly racist as it was nationalistic, as blatantly grounded in disinformation as it was in a politics of social division and white grievance. Even though his candidacy was openly rejected by traditional Republican power circles, they quickly came to understand that their attempts to build a grassroots conservativism had caused them to lose control over the force that they had helped call into being. The Overton Window in the US had shifted so far right by this point that the politics of Pat Buchanan, which the Republican base of the 1990s had rejected as racist, were now firmly entrenched as core Republican beliefs. The Trump campaign set about tearing down the remaining elements of the right that resisted his overt politics of racial division; in the process, it empowered the overtly racist elements within the right that had been gaining influence for years. Many commentators attributed this shift to the rise of the Alt-Right and its internet disinformation and trolling campaigns. In fact, the stage had been set for Trump long before, when the narrative of white communities at risk of destruction gained currency in the years following the Civil Rights Movement.

Thanks to the overt articulation of racist politics, the isolation of the right in a media bubble, and the construction of an absolute conflict between the right and all other political and social groups, the Trump campaign found a ready group of supporters. This mobilization invoked the idea of being under attack by “others,” but it also invited this base to serve as a force in offensive street action. The forces of militarization and social polarization that had been gaining ground on the right for years were unleashed in the street. All around the US, Trump supporters attacked immigrants, vandalized stores and places of worship, carried out mass shootings in the name of ethnic cleansing, and organized rallies and marches during which participants often attacked everyone from organized opposition to random passersby.

This mobilization enabled Trump not only to win the nomination and the presidency, but to marginalize practically all other factions of the Republican Party. This, in turn, created a situation in which normal conservatives were willing to consider taking on counterinsurgency roles on behalf of the state to defend the “homeland” against opposition to Trump, who has become synonymous with the rise of the white Christian “true America” to power.

This popularization of formerly fringe ideas has been widespread and terrifying. On the level of society, this manifests as a sort of cultural warfare, instilling inescapable and constant fear: immigrants fear being rounded up, dissidents fear being targeted by the state or right-wing vigilantes, targeted groups fear discrimination and police racism. Over the past four years, elements of the overtly racist right have openly mobilized in the streets, causing a massive social crisis—yet this has also driven elements of the left and left-adjacent circles to mobilize against rising fascist activity, and they have largely succeeded in driving the far right off the streets again, or at least limiting their gains.

Meanwhile, the Trump administration has not hesitated to use the mechanisms of the state to crack down on dissidents and harass populations considered to threaten the re-establishment of white hegemony, while continuously spreading disinformation to construct a parallel reality. The justification for targeting dissidents is descended directly from the concept of defending “real America” from attack by secretive internal enemies. Narratives that reinforce this portrayal of the scenario are promoted, regardless of verifiability, by an entire universe of right-wing media. Trump has positioned himself and the media outlets that support him as the sole sources of truth for his supporters. Consequently, he has been able to frame any opposition—even simple fact checking—as an attack against himself and his vision of America, separating his adherents from all other sectors of the American public.

What emerged is a sort of final act, a culminating move in the construction of the concept of civil war on the right. The right transformed from a force opposing everyone they considered immoral or un-American, including the state, depending on who was in power, to a force that was completely loyal to the state. In this transformation, the concept of civil war also underwent a fundamental shift from a notion of social or cultural conflict between defined social factions, as it was for the religious right, to a strategy of defending the state against oppositional forces. In this transformation, the concept of civil war acquired a central paradox, in which the term came to mean something wholly other than its initial connotations within right-wing rhetoric. It no longer denotes a conflict that occurs between social factions outside of formal state power; now it describes a conflict in which one political or social faction becomes a force operating alongside the state within a framework of counterinsurgency.

The Concept of Civil War

The concept of civil war, in its traditional sense, presumes that there are two or more political factions competing for state power, or else, a horizontal conflict between social factions that are otherwise understood as part of the same larger political or social category. In this framework, the factions that enter into conflict are either doing so directly, with the intention of eliminating each other, or in a situation in which the control of the state is in question, with different factions fighting to gain that control. The horizontality of civil war distinguishes it from concepts like revolution or insurgency, in which people struggle against the state or a similar structure such as a colonial regime or occupying army. To say that a conflict is “horizontal” does not mean that the factions involved wield equal political, economic, or social power—that is almost never the case. Rather, in this sense, “horizontality” is a concept used in the study of insurgencies to describe a conflict as taking place across a society, without necessarily being focused on the logistics or manifestations of the state. In shifting the focus of struggle away from the operational manifestations of the state, this understanding of civil war tends to isolate the terrain of engagement. Rather than centering the struggle in everyday life—in the dynamics of our day-to-day economic and political activities—this understanding of civil war engenders a series of mutations.

First, it forces a sort of calcifying of the way the conflict is understood. Rather than the dynamic, kinetic conflicts that typify contemporary insurgencies, in which conflict manifests as a result of and in relation to everyday life, this way of seeing approaches social divisions as rigid forms. If we begin by assuming the existence of a fundamental social division preceding any questions about contextual political dynamics—as in the concept of cultural warfare embraced by the right—this will cause us to identify both the enemy and our “friends” as permanent and static entities. In this conceptual framework, these identities necessarily precede the conflict—they form the basis of the conflict within the original category of unity—and remain static throughout the conflict, as they are the terms that define the conflict itself. Consequently, partisanship becomes a sort of ideological rigidity in which actions are driven by a purely abstract definition of friendship and enmity.

There are clearly elements of the aforementioned “horizontality” in the current uprising and the reaction to it, and concepts of identity have played a key role in the way that the conflict has emerged, but the reality is more complex. If the social struggle that exploded into the streets in 2020 had simply been a conflict between right-wing social and political factions and their anti-fascist opposition, then the characterization of civil war might have been apt, just as it would have been if it were simply a conflict over who controls the state. But the actual scenario is profoundly more frightening than the clashes we have seen in Charlottesville, Berkeley, and Portland since 2016. In 2020, we have seen political factions functioning as para-state forces aligned with the state, working in concert with the police and openly engaging in counterinsurgency measures employing extralegal violence. The state is no longer simply refusing to act in response to violence between fascists and anti-fascists, as it had since 2016. Starting in summer 2020, factions within the state actively began to call these right-wing forces out into the street, while at the same time promoting conspiracy theories to legitimize militias and expand their reach within the moderate right, modifying DHS intelligence reports to justify the violence, and using the Department of Justice as a legal enforcement arm. Between August and November, all this took place in coordination with the messaging of Trump’s reelection campaign.

The traditional understanding of civil war implies a conflict between two distinct factions within a wider unity that defines both, as argued by Carl Schmitt. For example, a civil war would be an apt description of an open fight between fascists and anti-fascists over control of the state. The current scenario does not match that narrative. One element of the conflict is openly identifying as an element of the state itself, however unofficially; the perceived legitimacy of the right-wing position derives from their claim to be working in the interests of “America,” even if that involving opposing certain elements of the state. Describing the defense of the state as civil war creates the illusion of a horizontal social conflict, when in fact what we are describing is nothing more than informal policing.

This explains how the contemporary right wing embraces the police, soldiers, and murderers like Kyle Rittenhouse in the same breath. They understand themselves as fighting alongside the state to preserve it. It is not just that Trump has leveraged them for this purpose; their entire narrative propels them in this direction, rendering them willing participants in the establishment of authoritarianism under the banner of “freedom.” All the state has to do to mobilize them is to conjure an enemy and legitimize extra-legal action.

In calling them forward and sanctioning their actions, the state has employed a strategy with two clear objectives. First, to compensate for the state’s failure or hesitance to mobilize enough force to contain the uprising. Giving leeway to vigilante forces, the state enters a zone of exception that allows for violence not subject to the constraints that ordinarily limit what the state can do by force. Second, to construct the uprising as a threat. Taking advantage of widespread xenophobia, racism, and citizen militia mentality on the right, the state presented the uprising as something outside of America, posing a threat to America. This mentality is clearly confined to one segment of the American population, but that segment is all that is necessary for the operation to succeed.

For these moves to be effective, it was necessary to construct a threat that was both outside and internal. The narrative of “outside agitators” was mobilized to delegitimize Black resistance by denying that it ever actually occurred, insinuating that “outside agitators” drove the local rebellions. This narrative has been deployed across the political spectrum, from conservative Republicans to progressive Democrats, in a flagrant attempt to decenter the idea of direct, localized resistance. This served a number of different agendas. In cities governed by Democrats, it enabled local administrations to deny the failures of reformism; in more conservative areas, politicians used it to deny the profound racism at the core of the American project and to preserve the narrative of American exceptionalism. This effort to conceal Black resistance was easily debunked, as arrestee statistics around the country repeatedly showed that the majority of people arrested in local protests were from the immediate area and were hardly all “white anarchists.”

When the falsehood about “outside agitators” collapsed, Trump turned to defining whole cities as outside the realm of American legitimacy. This included threatening local officials, declaring that they had lost control of cities, and ultimately designating those cities as “anarchist jurisdictions.” This successfully mobilized right-wing groups to go into some of these cities and start conflicts, but ultimately, the reach of this ploy was limited. For counterinsurgency to succeed, it needs to employ narratives that are widely accepted—and uncontrolled “anarchist jurisdictions” failed this test. This narrative has been most effective when it focuses specifically on “anarchists,” defining the term as anyone involved in any sort of direct resistance, including marches. By promoting the idea that Americans face a dangerous adversary bent on evil, the Trump administration tried to construct the terms of a horizontal social conflict in which elements of the right could play a direct role in fighting the “anarchists.”

Calling the militia movement into the streets via a narrative of total conflict shifted the terrain of conflict itself. Where previously, the unrest emerging throughout society was directed at the state, suddenly those in revolt were compelled to contend with two forces, the state and the paramilitaries. In this mobilization of social conflict, the state was able to not only gain force in the streets, often leveraged through threats and direct political violence, but was also able to decenter the focus of resistance away from the state, and into the realm of social conflict.

In mobilizing paramilitaries, the state both leveraged and incorporated the social polarization of the past decades. This provided the state with a mechanism outside of the structure of law through which repression may take place. In embracing this informal force, the state adopted a strategy similar to the approach seen in Egypt and then Syria during the so-called Arab Spring, in which reactionary social forces were mobilized to attack uprisings.

When this took place in Egypt in 2011, the rebels in the streets did not allow this strategem to divert them from focusing on bringing down the Mubarak regime. But in Syria, the introduction of paramilitaries into the conflict not only hampered the uprising from focusing on the state, but also restructured the conflict along ethnic and religious lines, diverting the uprising into sectarian warfare and enabling the state to ride out the ensuing bloodbath. These scenarios were similar in that forces outside of the state were mobilized for the purpose of counterinsurgency, even if the kinds of force involved were different. As in Egypt and Syria, the struggle in the US could be diverted into sectarian violence. If this takes place, it will be the consequence of a fundamental misunderstanding of how the state functions and what the role of paramilitary forces is.

Though these situations differ in many ways from the one we find ourselves in, there is one common thread that ties them together. In Egypt, Syria, and in the current American context, the narrative of civil war initially developed specifically in communities that were aligned with the state. These communities conceive of civil war in paradoxical terms. On the one hand, there is a narrative describing a conflict between social factions, a “with us or against us” mentality. On the other hand, these social divisions are drawn along the same lines that define loyalty within the political space. The factions that see themselves as aligned with the state shape their identity largely around some sort of ideological project (such as right-wing Christianity in the US, for example) that they seek to implement through the state, leading them to see all opponents of the state as social enemies. In this framework, the concept of civil war becomes an analogue for a fundamentally different phenomenon, the voluntary involvement of those outside the state in its operations as paramilitary forces.

So the question confronting us is not whether to engage in civil war. Rather, the concept of civil war, as popularly understood in the contemporary United States, is a misnomer.

Law and Liberal Counterinsurgency

The emergence of this paramilitary phenomenon must be understood in the wider context of the development of counterinsurgency strategies as a response to the George Floyd uprising. Counterinsurgency theory is a vast field, emerging from colonial powers’ attempts to maintain imperialism in the wake of World War II. Beginning with British tactics during the Malayan Emergency in the 1950s, the model provided by those attempts to maintain colonial power came to exert profound influence on subsequent military and policing theory. Both “community policing” and the approach that the US military took during the later phase of the occupation of Iraq derive from thinking that originally emerged at that time. The primary goal of contemporary counterinsurgency, at its most basic, is to separate the insurgents from the population, and to enlist, as much as possible, this same population in initiatives to eliminate the insurgency. As French military thinker David Galula wrote in the 1950s, “The population becomes the objective for the counterinsurgent as it was for his enemy.”

Unlike the traditional understanding of warfare, which assumes a frontal conflict between identifiable, organized forces and the control of territory, counterinsurgency engages at the level of everyday life, where material action is taken and politics occurs. The terrain of the conflict is not space, necessarily, but rather security—the participants seek the ability to contain crisis in a given area, and then to expand that area. This has taken many forms—from the British brutally relocating entire populations to camps and the Americans napalm-bombing Vietnam to the softer approach of buying loyalty seen in the Sons of Iraq program during the Iraq War. However, the core of this approach is always a system that creates incentives for loyalty and negative consequences for disobedience, resistance, and insurgency. As many historians of US policing have pointed out, there is a cycle in which tactics developed in foreign conflicts are integrated into American policing and vice versa. Counterinsurgency is no exception; the earliest domestic appropriations of this approach were used to provide political victories for the moderate elements of political movements in the 1960s, followed by the emergence of so-called “community policing.”

The important thing here is to understand how this approach has been modified during the uprising that began in May 2020. In some ways, the response to the George Floyd uprising employed longstanding techniques—for example, the attempt to recuperate moderate elements. In other ways, we have seen a dramatic break with the techniques that the state relied upon until recently. To understand these differences, we can begin by tracing where they originate.

The discourse of law and order has formed the foundation of the contemporary prison-industrial complex and the explosive rise in prison populations—paving the way for “broken windows” policing, the militarization of police forces, mandatory minimum sentences, and the expansion of the prison system. This discourse relies on two fundamental elements: the state and the law. Following Carl Schmitt and Giorgio Agamben, we can describe the state as a formation through which the will of sovereignty is expressed, with the primary goals being the projection of sovereignty and the continuation of that projection. Within this construction of the state, law exists as an expression of sovereignty—but it is not the only possible expression. The state can suspend law, or supersede law, in an attempt to perpetuate itself.

We saw this play out during the George Floyd uprising, as elements of the state abandoned the framework of a police force limited by law, along with the idea that laws against assault, threats, and brandishing weapons apply equally to everyone. Though we often think of the state and law as phenomena that imply each another, the state exceeds the structure of law. When liberal activists wonder why cops appear to be above the law, it is because they literally are. The state is not premised on the construction and maintenance of laws—Stalin’s regime, for example, was often utterly arbitrary. The construction of laws necessitates the existence of the state, but the converse is not true.

Philosophically, the structure of law functions to the extent that there cannot be exceptions to the law—in other words, to the degree that the law is enforceable and that there are no moments outside of law. Yet laws—or, to be precise, the dictates of a sovereign structure—do not function simply through declaration; a Bill in Congress is just a piece of paper. Both the law and extra-legal impositions of sovereign will only take force via mechanisms that can impose them upon everyday life. The police are one such mechanism.

Understood thus, law exists as a sort of aspirational totality intended to cover all time and space and to regulate the actions of all citizens. Within this construct, any attack against the police is in some sense an attack upon the state itself. Attacking police, building barricades, and other such disorderly actions all serve to prevent the police from projecting force into an area. Even outside the framework of law, in a state of emergency and in open warfare, the structure of the occupying force and the ability of that force to impose the will of the occupiers functions only to the degree that they can crush resistance within that space. Accordingly, any illegal activity, from unpermitted street marches to open rioting and looting, must be stopped at all costs—otherwise the hegemony of law will degrade, eventually leading to the disorganization of the police and the breakdown of the state.

The narrative of “law and order” presents this concept of law as the absolute definition of life and existence. The formal argument in the US political context is that law must apply to all people in the same way all the time, though we all know that this is never the reality and that in fact, the administration itself does not adhere to the law. Under the Trump administration, the state takes the form of a traditional extra-legal sovereignty structure, via which the will of the sovereign imposed through force and law serves as a convenient mechanism to criminalize any form of resistance.

This tendency to employ the state as an extra-legal apparatus for imposing sovereignty has manifested itself in a variety of forms—including the argument that people who attack property should spend decades in jail, the use of federal law enforcement to protect buildings from graffiti, and the use of federal charges against protesters, often for actions that local officials would not have deemed worth prosecuting. The goal is clear: to suppress the uprising in its entirety, rather than to regulate or channel its energy. This approach largely failed, often provoking severe reactions in places like Portland, where the presence of federal law enforcement on the streets energized the uprising and inspired some interesting tactical innovations.

The other side of this counterinsurgency puzzle is an emerging form of liberal counterinsurgency. Liberal counterinsurgency is nothing new. We can trace it to the attempt to moderate the labor movement after World War II and subsequent efforts to contain the Civil Rights Movement; the current strategies are familiar from the later days of the Iraq occupation. The fundamental move here is to provide an access point through which elements of a political faction or movement can get involved in the state. Sometimes this is through the mechanism of voting and the channeling of resistance into electoralism. If that fails, or if the crisis is acute enough, the state will attempt to incorporate these moderate elements directly by appointing them to government positions, including them in committees and in the constructing of policy. Arguably, the beneficiaries of previous applications of this technique form the core of the contemporary Democratic Party, which is comprised of the moderate wings of various political initiatives, all of whom were given access to some element of power. The final move in this strategy is to delegitimize or crush the ungovernable elements that refuse to compromise.

At its core, liberal counterinsurgency relies on fracturing political initiatives, uprisings, and organizations, sorting the participants into those who can be recuperated and those who must be eliminated. We saw elements of the state and various aspiring state actors employ this strategy in response to the George Floyd uprising. Early on, this took the form of conspiracy theories about outside agitators and agent provocateurs; eventually, it progressed into discourse about the importance of peaceful protest, a focus on defunding the police rather than abolishing them, and calls for people to follow the leadership of community organizers who were attempting to pacify the movement.

Liberals have attempted to completely reframe what has occurred in the United States since May within the context of acceptable politics. They have worked tirelessly to produce studies showing that the majority of the demonstrations were “peaceful.” They have spoken in the media in support of the uprising, but only mentioning elements adjacent to the uprising who were already associated with the electoral system, such as the various candidates and politicians who got tear gassed for the cameras. They have condemned the actions of the police, but only as violence perpetuated against the “innocent.” The move to glorify peaceful protest implicitly excludes and condemns those who do not fit this narrative of legitimate resistance.

Once the most radical elements are delegitimized and excluded, liberals move to criminalize them, even going so far as to justify police force against ”rioters,” often in the same cities where politicians started by condemning police violence. To hear them tell it, legitimate “peaceful” protests were hijacked by violent elements and outside agitators: illegitimate participants undermining the goals of the protests. Those of us who were in the streets at the end of May know that this narrative is absurd—people were fighting back from the moment that the cops shot the first tear gas—yet it has gained favor in liberal circles. This narrative is an attempt to hijack the uprising, to draw what was an ungovernable, uncontrollable element in direct conflict with the state back into electoral discourse.

Regarding the narrative that focuses on defunding the police—a proposal that means different things to different people—the liberal political class immediately began to insist on articulating demands that could be addressed to the state. This follows a pattern familiar from the Occupy movement and the rioting after police murdered Michael Brown in Ferguson in 2014. Structurally, the act of formulating demands suggests that the state is a legitimate interlocutor; it frames an uprising as a sort of militant lobbying directed at the state. By insisting on a model that centers demands, liberals position the state as the chief mechanism through which “change” occurs, ruling out the possibility of fighting against the state and the police themselves. The purpose of the demand is not so much to “win concessions” as it is to force potential uprisings back within the bounds of “acceptable” politics mediated by the state; this is why politicians always insist that movements must articulate clear demands.

By framing the discussion around demands to defund the police rather than attempts to abolish or eliminate them, liberals shifted the discussion to the less threatening arena of policies and budgets. This also enabled them to provide the moderate elements involved in the uprising with access to political power, in order to channel that energy into the formal legislative process. The irony is that the George Floyd uprising is a result not only of the long history of racism in the United States, but also the ways that prior attempts at liberal reform have failed.

This liberal counterinsurgency led to an inevitable conclusion: in August, Joe Biden directly declared that riots are not “protests,” essentially asserting that only attempts to engage in dialogue with the state are acceptable and that the full force of the state should be used to crush whatever ungovernable elements of the uprising remain. Biden combined both approaches—both repressing and coopting—by separating “peaceful” protesters from “rioters” and “anarchists,” then speaking directly to the most moderate demands for police reform.

Biden expresses the other element of the core paradox within state strategy: the state will allow protests, but redefines protesting to eliminate resistant elements. The goal is to provide an outlet, to allow people the opportunity to express complaints about particular state actions as long as no one challenges the state itself or the bureaucracies and parties that interface with it. This approach is fundamentally grounded in the concept of containment, according to which the state does not necessarily attempt to eliminate crisis, but rather aims to keep whatever happens under control via management and maintenance.

In the response to the George Floyd uprising, these differing approaches to law and security functioned to undermine each other; this is what set the stage for the emergence of para-state forces in response to the uprising. The “law and order” approach, based around imposing sovereignty through force, created a situation in which the forces of the state were empowered to employ increasing levels of violence to suppress the uprising. As we have seen in the streets, the use of impact munitions, beatings, arrests, and tear gas in 2020 has far outstripped any precedent in recent protest history. In response to these tactics, we saw an escalation on the part of the rebels in the streets, increasing numbers of whom began to form shield walls, bring gas masks, throw stones, and set fires, occasionally even employing firearms or Molotov cocktails. These were not aberrations, but common tactics emerging across a wide geographical area, fundamentally endangering a liberal counterinsurgency strategy based around containment.

As conflict escalates, containment-based approaches encounter two difficulties. First, it becomes increasingly challenging to identify more moderate or “innocent” elements and to isolate them from rebellious elements. Likewise, as state violence intensifies, it becomes harder to make the argument that reformism is valid or effective. Rebels on the street became more uncompromising as the uprising stretched on, seeing how increasing police violence indicates the failures of reformist approaches. Second, containment-based approaches reveal a fundamental contradiction. These approaches necessitate legitimizing some element of the uprising, which means acknowledging the legitimacy of the critique of the American political project it articulates. Yet as an uprising becomes increasingly uncontrollable, legitimizing these criticisms is tantamount to legitimizing the violence of the uprising itself.

As the liberal approach to counterinsurgency contributed to legitimizing the narrative of the uprising, it came into conflict with the law-and-order approach. The law-and-order approach drove militancy in the street, which in turn drove increasingly egregious police responses, rendering it increasingly difficult to contain the crisis. At the same time, because liberals took the position of supporting the core criticisms articulated via the uprising, they could not easily abandon those assertions, even as it became difficult to find elements that would abandon those who remained active in the street. This is what created the situation in which elements of the state were compelled to exceed the bounds of the law. In this context, the state resumed its essential nature as an imposition of sovereign force, in which law is only one of several possible manifestations, but at the same time, it also began to make space for extralegal para-state forces. This, in turn, created the conditions for far-right elements to receive leeway to operate outside of the law.

The inclusion of social forces from outside of the formal state structure in counterinsurgency strategies contains in microcosm several dynamics that have always been latent in US politics. It is from this perspective, in view of the contradictions latent in the counterinsurgency strategies deployed against the uprising, that we should understand the emerging discourse of civil war.

Social War, Not Civil War

The mobilization of paramilitary forces outside the limitations of the law points to a core element that is essential to this specific counterinsurgency operation as well as to the state in general. Throughout the Trump administration, we have seen the norms that formed the foundations of the perceived legitimacy of the democratic state erode. As this veneer has worn away, the state has also lost the ability to confine conflict within the bounds of the legislative process. Over the past three years, the relationship between the state and society has become increasingly characterized by material conflict. The Trump administration has used executive edict and raw violence to impose an image of America derived from the far right. This is the state as material force, pure and simple. Under Obama, repression was associated with failed compromise or the surgical precision of surveillance and drone strikes; under Trump, the naked repressive force of the state is laid bare for all to see.

Inherent in the functioning of the state is the defining of what is inside it and what is outside of it. According to the philosopher Thomas Hobbes, for example, what is outside of the state is described as the “state of nature” in which life is allegedly “solitary, poor, nasty, brutish, and short.” This account of the “outside” justifies the existence of the state as a mechanism to prevent what is outside from manifesting itself. Inside the state, the sovereignty of the state is considered to be total, while the outside is understood as any situation in which the sovereignty of the state is absent, or at least threatened. In US political theory, the concepts underlying the state are held to be universal, supposedly applicable to all humans. Therefore, anything outside of the state—even if that outside is geographically internal—is considered an absolute other that must be destroyed.

Consequently, in the US, the paramilitary is constructed both as a force in social conflict with any geographically internal enemy defined as outside of the American project, and as a force inherently tied to the preservation of the state and the prevention of change. Until recently, the concept of the enemy was tempered by self-imposed limitations, which served to reintegrate rebels through liberal counterinsurgency methods or to concentrate state action chiefly within the legal system. Today, these limitations have outlived their usefulness and right-wing militias are eager to eliminate the “outside.”

Now that the state has dispensed with the niceties that served to conceal its core as a logistics of raw force, a few things have become clear. First, the structure of law as a concept that theoretically applies to all people equally was based in the assertion of a sort of universal inside that included all within the purview of the state. Dispensing with law except insofar as it can be manipulated to serve as a weapon, the administration has opened up a space outside of law, a terrain formed by the state of emergency. Second, the paramilitary is no longer a force separate from the state. From the perspective of the uprising, there is no distinction between struggle against the far right and struggle against the state. This is not a horizontal conflict on the level of society—that would assume that all the forces involved were part of the “inside.” Rather, this is a material conflict between the state and all those defined as outside and against it.

With the elimination of the universality of law, framed through the concept of equal protection, and the overt incorporation of the paramilitary into state counterinsurgency strategy, the language of civil war loses its usefulness. Civil war is fundamentally a conflict between social factions, but that is not what is occurring here. That framework actually distorts the current dynamics of engagement. We are not experiencing a conflict between social factions, regardless of how the right conceives of the conflict. Rather, by incorporating the defense of the state into paramilitary doctrine and framing this around a rigid set of ideological commitments (termed “freedom,” but which really represent forms of social control), the right wing has given rise to a political conflict about the state, its role, and the structure of state and police power.

If we embrace the concept of civil war as it has been constructed in the contemporary US context, we will find that this generates tactical problems. Embracing civil war as a strategic posture could cause us to neglect the terrain of everyday life, where the state actually operates and most conflicts play out. If we understand ourselves as contending in a civil war, we will likely look for a linear conflict between two identifiable forces fighting each other without regard to the material terrain.

What is at stake here is not just a conceptual distinction or a question of semantics. The core of the distinction is important to how we think of conflict in relation to the wider anarchist project.

Structures of law and capital always function to regulate and channel actions toward specific ends according to the will of those who wield sovereignty. Resistance is a concrete question of how to act to disrupt the operational logistics of the state—i.e., the police, in the broadest possible sense of the term, which is to say, all those who regulate behavior according to these dictates. If we embrace the posture of civil war, the conflict becomes conceptually displaced from the terrain of everyday life, in which the state and capital operate, into a zone of abstract opposition.

To frame the current conflict as a civil war is to describe the state as a secondary element, rather than the focus of action, and to conceptualize the conflict as a linear struggle between two rigidly identified factions, both of which are defined prior to the opening of hostilities. This approach would produce a social conflict in which the state will inevitably play a role, but in which we will fundamentally misunderstand the terms. Rather than seeking to understand the shifts that have occurred on the level of society and the ways in which the uprising has been successfully defined as an “outside” by the state, we would end up concentrating on only one element of the collaboration between the state and para-state forces. Essentially, we would replace a struggle for everything—for the whole of life itself—with a far less ambitious struggle against other elements in the social terrain.

Seeing things that way would end up limiting our tactical options. If we base our understanding of the terms of conflict around broad conceptual categories, it will be harder for us to strategize for a kinetic conflict with the state that is in a constant process of change. In fact, adopting a framework of rigid linear conflict tends to produce conditions in which popular resistance becomes impossible. Contagious popular resistance presupposes the breakdown of the limits of the political; it manifests at the moment that the distinction breaks down between those who define themselves and their actions “politically” and those who do not. This was what made the uprising so powerful, unpredictable, and transformative, enabling it to exceed the state’s capacity to impose control. Constructing a linear conflict between predefined factions according to the framework of civil war, we would reduce those currently outside of the self-identified political movement to bystanders, lacking agency in the conflict yet still suffering its side effects. Reducing our understanding of the social terrain to the task of identifying who is “us” and who is “them” would ultimately distract us from everyone who is not already tied to an identifiable faction and from all the ways that we could act to transform that terrain itself.

The George Floyd uprising has shown us the power latent in this concept of popular resistance, understood as a dynamic resistance. Over the past several months, the limits of the political have fundamentally ruptured, as popular understandings of the possibilities of political action have expanded to include all the elements of everyday life alongside traditional forms of activism. In this rupture, we can glimpse the dynamics of successful uprisings: the breaking down of the limitations that confine conflict within particular bounds, the generalization of this expanded sense of political conflict throughout everyday life, and the abolishing of the distinction between political spaces and other spaces of life. To embrace the framework of civil war in this context, in the ways that this concept has been defined and manifested by the right, would be to abandon the possibility unleashed by the uprising. It would mean turning away from a dynamic conflict that has been opaque in its sheer complexity and awe-inspiring in its scale. It would mean abandoning the social terrain, and, as a result, the dynamic, kinetic possibilities of popular resistance.

A Brutal History: Slave Patrols and Building a Racist System with Political Power

In the US, the modern context of ruthless policing or oppressive social control originated as far back as the 1790s. The Charleston City Watch and Guard controlled the movement of the slave population at the time. The Guard was armed with swords and pistols, and it imposed a nine o’clock curfew for Black residents of the city. White slave owners wanted to prevent uprisings and revolts. Patrols closely monitored those in captivity, especially when they were working outside of the sight or the control of the enslaver. 

The creation of the first publicly funded police force, in Boston, was in the 1830s. By the 1890s, every major city in the United States had a police presence, born from racist, slave patrols in the era of slavery and relied on through  Black Reconstruction, and the Jim Crow era. 

Now, rather than upholding slavery, cops enforce laws and policies similarly meant to control the lives and movement of Black people. The late 1960s and early 1970s was a period of enormous social turmoil that raised the possibility of revolution. All fundamental institutions of society—the government, the “free” market, the military and war, the police, the nuclear family, white supremacy and others—were challenged. The elite, white, ruling class responded to these direct challenges to their power with Lyndon B. Johnson’s “War on Crime,” followed by Nixon’s “War on Drugs,” which were jumping off points for subsequent administrations to maintain their preferred social order. The “War on Drugs,” renewed with vigor by Ronald Reagan, still rages, and the U.S. has had the highest incarceration rate in the world since at least 2010. The increase of law enforcement in schools creates a “school to prison pipeline,” in which out-of-school suspensions, expulsions, and school-based arrests are increasingly used to deal with student misbehavior, especially for minor incidents, and huge numbers of children and youth are pushed out of school and into the juvenile and criminal justice systems. Not surprisingly, children of color (as well as children with disabilities and children from other vulnerable populations) are disproportionately targeted with these punitive measures.

During the 1980s, the ideology of “zero tolerance” school discipline originates from the “get tough on drugs and crime” policies of that era. This was also the dawn of mandatory minimum sentencing laws — fixed sentences for individuals convicted of a drug crime, with no judicial leniency allowed.  More than 1.6 million people are arrested, prosecuted, incarcerated, placed under criminal justice supervision, and/or deported each year on a drug law violation. “Three-strikes” laws, now in place in 28 states after first appearing in 1994, require anyone previously convicted of two or more violent crimes or serious felonies to receive a life sentence upon a third felony conviction,, regardless of the circumstances or, as in California, sometimes even the severity of the offense (e.g. felony petty theft).  

The Clinton Administration’s Violent Crime Control and Law Enforcement Act of 1994 was the largest crime bill in the history of the country. It provided 100,000 new police officers, $9.7 billion in funding for prisons, and $6.1 billion in funding for prevention programs.

The “War on Terror,” following the September 11, 2001 attacks, was a catalyst for the use of military grade weapons on protestors, most conspicuously in Ferguson in 2014, following the fatal police shooting of Michael Brown. So began the Black Lives Matter movement

Cops are Tools of Class Oppression and Mass Incarceration

For decades, starting in 1966, school districts across the country employed the “Officer Friendly” program that brought cops into local Elementary classrooms. Their goal was to indoctrinate children with the belief that the police are an indispensable part of society, who not only uphold the law but protect them. Perhaps this is because the police were established to protect the interests of the wealthy. Racial violence has always been a part of the mission to protect private, crooked institutions.

The institutions that the State has endowed with the most direct power over people’s lives, and a disproportionate share of tax dollars, are the police, prisons, courts, and the military. These enact forms of legalized punishment and repression under the guise of neutrality by being “bound to laws.” In reality, the laws primarily serve one class: the wealthy. Cops are the primary line of defense for a small fraction of the U.S. population – a handful of private corporate owners. A clear example of this is the role police played in the housing crisis. 

The number of empty, unsellable homes far exceeds the number of homeless. Based on currently available numbers, there are about 31 vacant housing units for every homeless person in the U.S. If policing served the people, cops would have arrested the bankers and the white collar criminals who made enormous profits by manipulating the housing market, even after their schemes created a massive global recession in 2008, and a spike in homelessness. Cops would be helping to seize homes to end, not create, homelessness. Yet evictions continue on a daily basis.

Who does policing target? Police are typically deployed to criminalize poverty, concentrating their efforts on criminalizing those with dark skin, forcing millions of people – primarily people of color, people with mental illness, and those in poverty – into the prison system, depriving them of voting and employment rights, and thereby preserving privileged access to housing, jobs, land, credit, and education for whites. Police are used to break strikes and assault picket lines, where workers are struggling for basic human rights and better conditions. Protests and uprisings during the Black Lives Matter movement have resulted in the use of military crowd control techniques. The political aim of the police is seemingly to silence the demonstrators and curtail their constitutional right to free speech and freedom of assembly, especially Black, Brown, Indigenous folks, and communities of color.

The Violent Military Industrial Complex Leaks into the U.S. Police State

The Military Industrial Complex is directly connected to policing and the Prison Industrial Complex in this country. American policing has become unnecessarily and dangerously militarized, in large part through federal programs that have armed state and local law enforcement agencies with the weapons and tactics of war, with almost no public discussion or oversight. The U.S. already acts as the police force of the world, enforcing authority through drone warsproxy battles, and meddling. Black liberation is a global struggle, and there is a link between racial oppression internationally and domestically. A militarized police is only equipped to escalate situations.

Throughout US history, the police (including federal policing agencies like the FBI) have attacked and undermined social justice organizations and efforts, at home and abroad, through various forms of surveillance, infiltration, sabotage, and assassination. The political function of the police destroys any form of revolution, so it’s no surprise that in the 10 years of anti-establishment social unrest between 1965 and 1975, the number of police officers grew by roughly 40 percent nationally. In 1974, $15 billion was spent on criminal justice, 57 percent going directly to police expenditures4. With this increase of spending, the FBI’s infamous COINTELPRO “neutralized” political dissidents and threats, like the Black Panther Party, through subterfuge and extreme violence. In league with local police units, the FBI declared war on radicals and groups from nationally oppressed communities. Then, the Special Weapons and Tactics (SWAT) teams were first formed in Los Angeles in 1968. Fifty years later, the US still holds these political prisoners captive, like Mumia Abu-Jamal. The Free Them All Campaign continues to advocate for their release, even as the police continue to use these tactics against protestors today

Using federal funds, state and local law enforcement agencies have amassed military arsenals to wage the failed “War on Drugs,” disproportionately in communities of color. Aggressive enforcement of this mandate from decades ago has lost its public mandate, as 67 percent of Americans think the government should focus more on treatment than on policing and prosecuting drug users. Aggressive drug arrests and prosecution has impacted millions of lives , disproportionately in communities of color, though drug use rates are quite similar across race and class. Law enforcement agencies’ routine use of heavily armed SWAT teams to search people’s homes for drugs is the same hyper-aggressive form of domestic policing that killed Breonna Taylor.  

The militarization of American policing is evident in police officer training, which encourages them to adopt a “warrior” mentality and view the people they are supposed to serve as enemies. It’s also evident in the equipment they use, such as battering rams, flashbang grenades, and APCs. The 1033 Program transferred surplus military equipment to civilian police departments. Only 45 days after the September 11, 2001 attacks, Congress effortlessly passed the Patriot Act , which George W. Bush signed less than a month after the United States invaded Afghanistan, as part of the “War on Terror”. It broadly expanded law enforcement powers to search, surveil, investigate and indefinitely detain people. Among its effects, the Patriot Act has been used to expand the racist war on drugs

Additionally, the Department of Homeland Security, created in 2002 to coordinate government intelligence gathering in order to improve counterterrorism efforts,  has set up centers with the FBI and local police that have been used to spy on protest movements, from Occupy Wall Street to Black Lives Matter. More than 7,000 people were arrested during the Occupy movement over the course of just a few months. These arrests, alongside incidents of police brutality, were intended to stamp out a movement that took aim at the face of class oppression from the rich, elite of Wall Street.

Since May 2020, the uprising spurred by the police lynching of George Floyd, has intensified the militarized mobilization of law enforcement. The police forces are equipped in full riot gear and use weapons designed for war. Black and Brown activists in the United States, especially during the Ferguson protests, have described domestic police departments as “occupying forces,” much like those in Afghanistan or Yemen or Palestine. In fact, allowing Israeli forces and U.S. participants to learn from each others’ violent practices and tactics results in the violation of the human rights of Black and Palestinian people, but there are efforts to end this through a campaign called, “End the Deadly Exchange.” Our police, at the behest of local government, wield not only military arms, but what they’ve learned from the military’s formal joint training, tactics (both street combat and psychological operations), and other means of  suppression. At least 200 cities in the U.S. had imposed curfews by early June, while more than 31 states and Washington, D.C. activated over 75,000 National Guard personnel, arresting over 10,000 people. Yet widespread police brutality and the mobilization of military law enforcement tactics, like kidnapping protestors, have only furthered massive civil unrest. 

The Case for Revolutionary Optimism: A Path towards Abolition

So, how do we fight an institution doing what it has been designed to do, one that’s protected by government leaders and employment contracts, and is therefore incapable of reform?  The problems of punitive, racist policing are cultural — ingrained in our society — and cannot be solved by merely identifying a couple murderers or “bad apples,” if you will. 

Given how corrosive policing has historically been and continues to be, it shouldn’t be surprising that with alternatives, our society could flourish without cops. Policing could, and should, be defunded and abolished.

A society that prioritizes human needs ahead of profit means communities that have sufficient housing, food, health care workers, prisoner re-entry services, and community practices that hold all of its members accountable for any harm and enact restorative justice. Mutual aid, rather than one-time giving events, would allow us to share our skills collectively and all contribute. 

It may seem implausible or unreachable. It requires divesting from police, prisons, and the military, and instead, investing in communities of color and supporting the public policies that encourage, not inhibit, family-sustaining wages, job development, education, and the equitable distribution of resources. We cannot accept corporate, private interests to define our way of living. The ruling, capitalist class is in power, controls our government policies, and we must not capitulate to the world they want us to live in. It is one with an illegal slave system that is the Prison Industrial Complex. A society with an abolitionist as a focus will not be built on the violence of a capitalist state designed to defend property and capital, but one in which the people are empowered to provide for each other. 

We must build class unity and solidarity through organizing within our communities to protect one another. There are few tools within the system to fight the State’s abuse politically and legally, but we can ask for the immediate release of inmates in this country’s tortuous prison system; the end of three strikes and overly harsh sentencing guidelines; changing the 13th Amendment to eliminate the clauses that allow for slavery and “involuntary servitude” for people who are convicted; the end of qualified immunity for officers; the repeal of federal programs that send military equipment to local police; the end of “Broken Windows” policing tactics, including stop-and-frisk and other police harassment tactics; the prohibition of no-knock entry; and laws that make it harder for the police to obstruct free speech activity. 

While these are only reforms, we can also strengthen community accountability models that critique punitive systems that maintain repressive, colonial ideology.  Together, we can connect movements, groups, and individuals to transgress the boundaries of institutions. These alternatives must include continuing critiques to improve social conditions, as well as provide accessible, sustainable levels of resources that are consistent with anti-capitalism, anti-racism, and anti-colonialism principles. This is how we can transform and empower communities towards justice and abolition.

 

Black American Apathy and Internationalism

For those organizing African people towards Revolutionary Pan-African Socialism, a Joe Biden presidency is not a win. It’s a detriment. Understanding neoliberalism breeds fascism would mean that it is a mistake for anyone alleged to be of a “radical politic” to celebrate Biden becoming the president-elect and, by extension, celebrating his running mate, Kamala Harris. Unfortunately, many Africans in the US have strapped themselves in willingly for a presidency that will attempt to be even more hawkish than the Barack Obama administration in every warmongering, drone-dropping, coup-backing, militarized-policing way.

Much of the issues around internationalism stems from a communal lack of political maturity, which helps one analyze their material conditions as they are. Furthermore, a lack of political education obstructs international solidarity with Africans and oppressed people globally. African people in the US make up a colonized nation not dissimilar to colonized nations always under attack by the strongarm of US imperialism and their western allies.

The US military and its 400 bases worldwide serve as occupiers in the same way the (overt) police state does in our neighborhoods. What is the difference between the US African Command (AFRICOM), which is said to “combat the War on Terror,” and militarized policing units like Operation Relentless Pursuit and Operation LeGend, both used in multiple cities across the country to “combat crime and domestic terrorism”? What is the difference between the murderous Israeli occupation of Palestine and the occupation of a colonized neighborhood in the US using IDF trained police units?

There is no difference.

The primary contradictions of imperialism have been distorted by dishonest conversations around “anti- Blackness,” as well as a new sense of American ‘pride’ found in Black Americans that assists in framing all geopolitical issues from an ‘us vs. them’ lens. Global and domestic imperialism are counterparts. African people’s allegiance to the US, and military enlistment, has always existed as a contradiction within the community. While it may be true historically African people were the least favorable to war, Obama’s presidency set the stage for a bold backing of US imperialism by way of patriotism from ‘Black America.’

Although most unite under hating Trump, many earnestly believe the US is worth saving. Mass “get out the vote” mobilizations across the country ensued to “stop full-blown fascism” by asserting a false sense of power in electing a majority unfavorable democratic candidate. The mainstream media announcement of Biden as the 46th president has caused a mass reactionary hysteria and sighs “of relief” that things may return to normal.

As the celebrations have been going on, despite Donald Trump not formally conceding, Biden’s team has been busy, too. Names for potential cabinet members who range from the center to the right have been circling the internet. Jim Clyburn and other democratic centrist moderates are currently vowing to protect the country from going “socialist” by pushing back against the messaging of “defund the police.” 

Benjamin Netanyahu and Narendra Modi have congratulated the presumed  president-elect and madame vice president-elect, promising even closer ties and relations. Both Netanyahu and Modi are fascists, in their own right, and part of a more extensive global expansion of fascist leadership, yet neither Biden nor Harris find an issue in continuing the existing relationships despite the very real murderous actions of both men in their prospective countries against Muslims. Coincidentally, alleged crimes against Muslims is the same propaganda use to be actively aggressive towards China and President Xi Jinping that Biden intends to continue with through the Indo-Pacific Command.

With rumors of Dick Cheney potentially being an advisor to Biden on foreign policy, a majority conservative Supreme Court and a majority GOP senate would be a convenient cover for Biden’s actual geopolitics and non-plan for the poor working-class. Biden has built a career in the US government on criminalizing Africans and other colonized people in the US with the racialized “War on Drugs” through policy measures like the crime bill (domestically) and Plan Colombia (globally).

The “open-letter left,” which includes characters like Noam Chomsky and Medea Benjamin of CODEPINK, has decided, as a predominately white and economically stable coalition of signatures, to ignore historical materialism for the sake of ousting Trump. They have agreed that any policies that will place colonized people the most at risk, here and abroad, would be worth it so long as it’s not policies signed off on by Trump. Just like during the Obama era, the US left is proving itself useless in not only helping the masses comprehend imperialism but fighting against it by not voting for the man who has never seen a war he disapproved.

‘Black American’ apathy through American exceptionalism creates that “sigh of relief” people express now. The indifference to wars and occupation is the result of a rupture in the ability for African people to make the connections between a man promising more policing as a campaign strategy during the height of mass uprisings against the police to his aggressive rhetoric towards nations like Venezuela, China, Iran, etc. Nor the US’ role in establishing brutal neocolonial leadership in the Global South and on the Continent.

It is becoming more and more evident that despite the strengthening calls to ‘Free Palestine’ and more recent actions to ‘End Sars,’ internationalism will again become a backburner issue. How will Africans in the US combat this and re-establish the anti-war internationalism politics that cemented the Black Radical Tradition and politics of the past?

First, we must ruthlessly attack the aversion to political education. The lack of understanding of the Third World struggles adjacent to the struggles of Africans in the US has resulted in liberal reactionary responses to anti-imperialism. Imperialism can not continue to be a vacuum issue by Africans living within the empire of the US. This isolated framing of the world prevents the practice of revolutionary internationalism – international solidarity against the same white supremacist forces that oppress Africans domestically. We are witnessing the frantic reactionary calls to “let people enjoy things” for the sake of identity reductionism.

Online discourse centered around anti-imperialism is met with push back primarily because people do not possess the political maturity to comprehend the ways imperialism materially affects their everyday lives and the importance of internationalism. Once Africans in the US understand themselves as colonized people on stolen land, there will be a more precise analysis of how liberation is sought and gained through tactics not tied to revolutionary internationalism – not to continuously voting for one’s demise.

For colonized people within the imperial core, there should be no allegiance to America.

We Need More: On Police Brutality, Reformism, and '8 Can't Wait'

At this point, I’m sure everyone reading this is well aware of the uprisings that took place across the country and around the world following the deaths of George Floyd and Breonna Taylor. I’m sure you’ve all seen your social media feeds filled with a slew of heartfelt proclamations that Black Lives Matter, personal stories of discrimination and loss, as well as ways to move forward from these tragedies, enact change, and achieve some measure of justice for those murdered by police. Chief among the many campaigns that have been circulating is 8 Can’t Wait, a project by Campaign Zero.

Since COVID-19 threw a wrench in my summer plans, I spent break commiserating with friends and comrades, watching police beat and arrest protesters, and endlessly doomscrolling through Twitter. But in the weeks and months after the grisly video of cops slowly killing George Floyd was released, I noticed more and more posts across social media from friends, family, and strangers alike all repeating the same phrase: “8 Can’t Wait.” Tentatively hopeful, I dug in.

Was an abolitionist project finally breaking through to the wider public? Was Angela Davis involved? These were my initial thoughts, but as I dug further and learned more about this social media phenomenon, my hopes shattered replaced only with the same numbness I felt freshman year when my roommate told me, without a hint of irony, that if every police officer were made to watch the Green Book — starring Mahershala Ali and Viggo Mortensen — police violence would plummet. Now I hope I shatter your hopes as well.

8 Can’t Wait was launched in early June in response to the killing of George Floyd and quickly gained steam on social media and in the news. Fawning think pieces and op-eds everywhere from Vox to Rolling Stone to GQ to Variety accompanied glowing endorsements from high-profile political and cultural figures such as Barack Obama, Oprah Winfrey, Ariana Grande, and others, lauding the project’s “succinct and clear message” and potential to save lives. At the core of the effort are eight “data-driven” reforms that Campaign Zero claims would decrease police killings by an almost unimaginable 72%. At first glance, the reforms look promising:

  • Ban Chokeholds and Strangleholds

  • Require De-escalation

  • Require Warning before Shooting

  • Exhaust all other means before Shooting

  • Duty to Intervene

  • Ban Shooting at Moving Vehicles

  • Require Use of Force Continuum

  • Require Comprehensive Reporting

Think of all the deadly encounters that could be avoided if police were required to de-escalate. Or the lives that could be saved if chokeholds and strangleholds were banned across the country. However, the assertion that widespread implementation of these eight policies would result in anything close to a 72% drop in police killings is misleading at best. Countless cities, townships, and states across the country have already enacted many of the reforms 8 Can’t Wait prescribes. Many large cities like New York, Los Angeles, and Philadelphia already have at least half of them. In fact, Campaign Zero confirmed both Tucson and San Francisco have all eight policies in place. While claiming to reduce police killings by 72% certainly grabs attention, in reality, many cities would only see a fraction of that reduction, and that’s assuming that 8 Can’t Wait’s analysis of the data is reliable. Chicago, a hotbed of police brutality, witnessed 76 police killings over the past 7 years, 56 of them black. The city also already has seven of the eight reforms listed by 8 Can’t Wait, so the people of Chicago will have to look elsewhere for jaw-dropping reductions of police killings.

Unfortunately, Campaign Zero’s supposedly “data-driven” policies aren’t exactly as clear-cut as they claim. In their own study, they allege that the average police department, out of the 91 that they analyzed, already had three of their eight recommended reforms. Right off the bat, that finding throws their fantastical 72% reduction of police killings out the window for the majority of cities, and those with only one or two policies aren’t guaranteed anything close to a three-quarter reduction in police killings. The aforementioned 2016 study that Campaign Zero conducted and based 8 Can’t Wait on contains methodological issues that seriously undermine the bold claims that it’s being used to support. It compiles data from just 91 police departments over only an 18-month period.

It’s well documented that police departments and officers get away with heinous violations of human rights and civil liberties all the damn time. As things currently stand, police, as individuals and as an institution, enjoy nearly limitless legal protections.

For example, in July 2016, police officers brutally attacked and arrested Shase Howse, who was looking for his keys in front of his home, after he replied “Yes, what the fuck?” when asked if he lived in the building. Ludicrously charged with multiple felony counts, Howse lawyered up and the charges were dropped.

If, like me, you wondered how Howse’s attackers got away with physically assaulting an innocent man then lying about what happened, it’ll probably make you as angry as I was to learn that police lying not only in their post-incident paperwork but in court and in affidavits is so common that cops themselves have a word for it — “testilying.” In fact, it’s so ridiculously bad that even the quintessential conservative (and fucking creepy-ass weirdo) himself, Alan Dershowitz, has said that “Almost all police lie about whether they violated the Constitution in order to convict guilty defendants” and that “All prosecutors, defense lawyers, and judges are aware of [that].” As bad as all that sounds, don’t worry. It gets worse.

Justifiably upset at what happened to him, Howse tried to sue the officers in federal court for excessive force. He lost. As it turned out, those officers are protected by qualified immunity, a legal doctrine affirmed by the Supreme Court that protects government officials from civil liability unless they violate a “clearly established” right. In essence, Howse, along with every other individual in the country, has no clearly established right to not be assaulted on his porch. Qualified immunity is just the tip of the iceberg when it comes to the astronomical number of “get out of jail free” cards that cops have. So you can rest easy knowing that cops can do basically whatever they want, especially if you’re poor and a minority, and get off either scot-free or with a slap on the wrist.

The issue that liberals like those behind 8 Can’t Wait are either unable or unwilling to grasp — and that abolitionists have been calling attention to for decades — is that police brutality is a matter of power. So long as police are empowered to impose their will violently on the very people they claim to protect, injustice and suffering will continue, and no amount of pinky swears or promises will curtail that power. While projects like 8 Can’t Wait appear well-meaning in their focus on police killings and how to reduce them, the oppression of poor and marginalized communities does not begin or end with a single statistic. 8 Can’t Wait is hampered by statistics that lack geographic, political, and historical nuance and, instead, tries to simplify the systemic issue of policing down to specific, personal, lethal encounters.

Any successful attempt at beating back the tide of police killings must reckon with the whole of the issue, which means recognizing and challenging police militarization, the prison-industrial complex, and our cruel, predatory criminal (in)justice system. In other words, abolition is the only sustainable, truly effective way forward. Applied to the realm of police killing, the abolitionist theory of change demonstrates that the only way to permanently end the violence at the hands of police is to dismantle the entire rotten system such that police officers and departments don’t have the tools or ability to deal out death and suffering. The tepid reforms Campaign Zero puts forth with 8 Can’t Wait do nothing to shift power away from police, and their failure to address the near-complete lack of accountability and oversight that police departments across the country enjoy seriously compromises the potential effectiveness of the already-limited policies that 8 Can’t Wait is pushing.

The frustrating thing about incrementalist reform projects like 8 Can’t Wait is that there’s no need to wave around in the darkness searching desperately for any way forward. The abolitionist movement has been around for decades, created and led by black scholars and activists, such as the black queer women of the Combahee River Collective. From the modern carceral state to American policing’s origins in slave patrols and explicitly discriminatory night watches, abolitionists such as Angela Davis, Mariame Kaba, and Keeanga-Yamahtta Taylor have spent years illuminating the fundamental cruelty of police and prisons as an institution and, more importantly, blazing a path toward an alternative future where our response to crime is not to incarcerate and punish but to rehabilitate, strive for restitution, and address the underlying causes of crime, such as poverty and a lack of social welfare programs.

While there is no single, concrete path to abolition, there are clear next-steps that abolitionists have emphasized for years — ones that would actually challenge the power of police, shrink the carceral system, and put an end to state-sanctioned violence, incarceration, and suffering. In fact, as a result of the infuriatingly shallow demands of 8 Can’t Wait, abolitionists from across the country have come together to form 8 to Abolition, a campaign focused on prison and police abolition that eschews the nitpicking incrementalism of 8 Can’t Wait, calling the project “dangerous and irresponsible” for “offering a slate of reforms that have already been tried and failed, that mislead a public newly invigorated to the possibilities of police and prison abolition, and that do not reflect the needs of criminalized communities.” Their demands are:

  • Defund police

  • Demilitarize communities

  • Remove police from schools

  • Free people from jails and prisons

  • Repeal laws that criminalize survival

  • Invest in community self-governance

  • Provide safe housing for everyone

  • Invest in care, not cops

A commitment to abolition in line with the demands set forth by the activists behind 8 to Abolition is absolutely imperative. The ultimate, guiding vision of the resurgent socialist Left must be one of abolition. The moral gravity of having a system of unaccountable arbiters of death and violence, enforcing a racist legal code of class oppression, throwing people in pens to be the slave labor of the modern capitalist economy makes the cause of abolition a necessary one. The fascist Right sees the role that the police and carceral state play in the perpetuation of white supremacy and bourgeois class domination. They think it’s great. The liberal Right throws its hands up in exaggerated shock, tosses a pack of Band-Aids to the dead and dying, and calls it a day. It is up to the working-class movement of the Left to fight like hell because, until all of us are free, none of us are.

How the Poor Continue to Die

Humanity has entered a period “where every day people are dying among strangers.”[1]  

Daily life itself has become “strange” and isolating as social distancing and quarantine measures are being lifted, then reenacted.  Federal troops operating as secret police in an attempt to occupy American cities, are repelled by protestors and the populace.  News cycles shriek and squall with nearly every pontification from the political class as they continue to carry out their “sacred mission,” which in recent memory is accompanied by squealing ineptitude in regard to improving the actual conditions of life.  Or, maybe they are not inept.  Months ago, at the onset of the pandemic, pundits and politicians had already declared that testing, treatments, and vaccines would not be offered to everyone.    

A pervasive level of violence, of frivolous intrusions into the routine behaviors of people of color, of a cruel disgust directed toward unhoused and poor peoples, of an impulsive need to regulate the expressions of those outside the gender binary, of a paranoid animosity toward immigrants and “antifa” and the “other” is being expressed by a particular sector of the population.  This sector – overwhelmingly good Christians, white, and middle-class – have been expressing this violence to such an extent that everyday life has been saturated by it.  For us “others” it is omnipresent, for many “others” it has been this way for five hundred years.  Yet, the poor continue to die, often “among strangers.”                      

In 1929 George Orwell was down and out in Paris and witness to the goings-on at a hospital that served the poor.  Seventeen years later he drew on his initial observations along with scribbled notes to complete the article “How the Poor Die.”  These words, published during the aftermath of the second World War, deserve our full attention in this moment: “However great the kindness and the efficiency, in every hospital death there will be some cruel, squalid detail, something perhaps too small to be told but leaving terribly painful memories behind, arising out of the haste, the crowding, the impersonality of a place where every day people are dying among strangers.”[2]  Then, as now, the gallant efforts of medical personnel, front-line and essential workers are often performed with kindness and efficiency, and with haste.  Nonetheless, the poor died in 1929 and 1946 in the ways they have continued to die, have always died.  In hospitals amongst strangers and in the streets, shanty towns and derelict apartments, in asylums and prisons, reservations and Bantustans. And if at all possible, in these same places, amongst relations, chosen as well as blood.    

Currently the cruelty of COVID-19 is compounded not just by social isolation but the realization that those who will die from this disease will do so among strangers.  On ventilators, in isolation units, in nursing homes, without the comfort of loved ones or human touch.  If the projections are correct, even with the recommended medical and social interventions, the dead will overwhelm the living.  It is likely that you, the humble reader, will be called upon to bury the departed, deceased, dead.        

As the dead overwhelm the living, dead labor will attempt to overcome living labor. “Capital is dead labour which, vampire-like, lives only by sucking living labour,” Karl Marx notoriously quipped, “and lives the more, and more labour it sucks.”[3]  What has become clear to large swaths of the populace, not just devotees to hundred and fifty year old texts, is that value and wealth in a capitalist society (the portion consumed in production and reproduction is dead labor) are produced only through the efforts and expended capacities of the working-class (which is living labor).  As Marx offered, “We mean by labour-power, or labour-capacity, the aggregate of those mental and physical capabilities existing in the physical form, the living personality, of a human being, capabilities which [they] set in motion whenever [they produce] a use-value of any kind.”[4]  And the great promise of Marx, of all revolutionaries, is that we will produce ‘goods and services’ useful to human beings in accordance with their needs and all of our abilities collectively.   

An economic system hell bent on endless growth has seemingly been replaced, possibly only temporarily, by shortsighted kleptocracy.  Extending well beyond the current administration, bourgeois society has embraced law breaking for themselves and harsh, hard-hearted punishment of the poor for minor property and drug “crimes.”  While this has always been, the contemporary American political class now flaunts its wrongdoings in full view.  With the endless accumulation of capital cast aside for the immediate acquisition of wealth, the imposition of work has become more malicious.  Front-line and essential workers and those in the service industry are being forced back to work at the threat of being destitute, with mass evictions looming.  The tiny deaths of exhaustion and daily injury have been replaced by the alternating certainty of death by starvation or death by pandemic.  Major retailers call them “heroes” as they take away their hazard pay.  And even school children, the sacrificial but essential workers of the future, are being sent back to their desks as home instruction and homework has not been sufficiently disciplinary.  All of this is evident with the return of a slogan, a capitalist maxim: Arbeit macht frei, or work will set you free. 

Pandemic and poverty is becoming plague and privation; those who are penniless will soon face famine. Without work there are no wages, without wages there are few ways to obtain the means of survival, the means of reproducing life itself.  Nevertheless, social reproduction is essential, and the work required – often unwaged, racialized, and gendered – is indispensable.  Since workers expending labor-power in the production process is how capitalism produces value, social reproduction is central to the capitalist mode of production.  As a result, the worksite where this is produced has become of key interest to the bourgeoisie.  Feminist scholar Silvia Federici noted this in the historical record: “The body, then, came to the foreground of social policies because it appeared not only as a beast inert to the stimuli of work, but also as the container of labor-power, a means of production, the primary work-machine.”[5]  The body as machine has been a central metaphor of our capitalist society, now the cogs are being discarded willy-nilly with automation and information computational processes that require fewer and fewer workers.  

Of the numerous realities the pandemic has uncovered, few are as stark as how front-line, essential, service industry workers are not just seen as replaceable but as expendable.  And many are out of work.  When a member of the working-class is without wages and the paltry handouts from the government vanish, reproduction of one’s biological functions and faculties are still required.  Working in front-line, essential, service industries is work as is seeking to obtain work in such sectors.  Working to reproduce one’s own capacities is work as is working without a wage to reproduce waged workers along with the “nonwaged, underwaged, not-yet waged, and no-longer waged,” to quote a contemporary feminist scholar.[6]  Hence, all of life has become work, with its simultaneous, and seemingly contradictory absence and total permeation.  Returning to Marx again:      

“the working day contains the full 24 hours, with the deduction of the few hours of rest without which labour-power is absolutely incapable of renewing it services.  Hence it is self-evident that the worker is nothing other than labour-power for the duration of [their] whole life, and that therefore all [their] disposable time is by nature and by right labour-time, to be devoted to the self-valorization of capital.”[7]  

Our whole lives have been subsumed by capitalism, and now, for far too many of our fellow human beings, death has become just as alienating.

In collective, common, liberatory moments of ‘great kindness and efficiency,’ ‘amongst relations, chosen as well as blood,’ we are given a glimpse of “a paradise of unbroken solidarities.”[8]  However, the means of communication, mutual aid, and social relations required to build such a paradise are often destabilize by the very forces that should be constructing them.  

Another underling reality exposed by the COVID-19 pandemic is final confirmation that the Left in the United States has been historically defeated, the working-class decomposed.  Although generalized austerity, violent repression, mass incarceration, direct attacks on unions and community-based organizations, restructuring of everyday life toward neoliberal and individualistic ends, culture wars, drug wars, endless wars against the populace are partially to blame.  But the Left must take responsibility for its internal operational failures, nonsensical squabbles, unprincipled and self-servingly middle-class politics.  This has left working-class and poor people to their own defenses, with limited material resources, against the pandemic and unfolding crises.  In effect, the poor continue to die in part due to this ineptitude, purity politics, and too often defenses of middle-class ideals and irrelevant academic ideas.  

To define such a sector of the body politic would take many more words than can be allotted here.  Simply put, this includes those who are “practically minded” members of the Democratic Party establishment all the way leftward to include some of the newly articulated Democratic Socialist alternatives, along with much of organized labor, the non-profit sector, as well as do-gooders and providers of social services.  Where the formal Left begins and the bureaucrats, bourgeoisie, social workers, and middle managers of our misery end is unclear, as they are often indistinguishable and hence what that follows is imprecise.  Beyond the established Left there are ongoing mutual aid efforts, wildcat and rent strikes, and uprisings amongst everyday people, often led by young Black insurgents.  These radical, revolutionary, and daring, spontaneous but still organized, abolitionists, anti-capitalists, and commoners are outside of the formal body politic.

Defensive and self-serving reactions in the guise of “What about small landlords?” and “What about family owned businesses?” have erupted on the Left in response to calls for rent strikes, paid sick leave, hazard differentials, and a little workplace democracy with the same veracity as “What about good cops?” and “Don’t all lives matter?” on the right.  Universal demands for income, healthcare, and housing seemingly require an addendum that first we must distinguish between who are the deserving and who are the undeserving poor.  Then, typed into the social media fields of too many who know better: “I support unions but just not at my business or workplace,” “I support tenants’ rights but just not my tenants,” “I support Bernie but what about these horrible ‘__________.’”  While I am paraphrasing, we will get to those who fill these blanks shortly.  Since we have addressed how the middle-class Left and the bourgeoisie defends itself against the rabble informally, we must look at their formal practices.                 

Saving “establishments,” from restaurant chains to retail stores, “public infrastructure” from universities to the library and post office, “private associations” from business improvement districts and landlord lobbying groups to social service non-profits, as well as the facades of representative democracy and private property, are being managed by grinning neoliberal “little Eichmann’s.”  Or, possibly worse, those who wish they were.  Deep austerity measures have been instituted by and throughout these establishments, infrastructures, and associations while money flowing into them has been accumulated by bureaucracies impervious to worker or citizen demands.  

All of life has become work, and to manage this all of life has been infected by bureaucracy.  What is bureaucracy and why is it so pervasive?  Member of the French group Socialisme ou Barbarie, Claude Lefort, has an answer: “one overlooks the fact that in one and the same movement the bureaucracy establishes itself at the heart of social life and presents itself as an end, that it responds to a technical need and subordinates it to the imperative of power.”[9] Bureaucracies, even progressive and liberal ones, have sought to silence working-class voices: in social services they sought to silence those of unemployed people and welfare recipients, in trade unions expressions of working-class self-activity, political parties those of the masses, universities those of faculty and student shared governance, corporations those of workers initiatives and demands, healthcare those of the ill and infirm, landlords those of their tenants, the legal system and prisons those of prisoners, and then there are others.  At the moment you can hear bureaucrats mumbling out of the side of their mouths, a proverb: “we have effectively silenced them in life, how dare they not be silent in death.”              

Moreover, the desperate need to feel “right” and “moral” is cover for those who ignore structural inequalities and stark differentials of power that exist and are now amplified in our society.  Far worse, after five hundred years of struggle against capitalism and the state most of the Left is willfully ignorant how social change occurs.  Nearly immeasurable personal choices and consumerist acts – such as voting, buying local, eating vegan or organic, riding bikes, being sustainable or peaceful or mindful or, which is by far the worst, conscious – are held as the apex of political action.  Or, maybe by appealing to the “better natures” of bosses and landlords, billionaires and politicians or “speaking truth to power,” things will progress, improve, change.  Worst still, if our arguments are right and true, clear and concise, we will win in the free marketplace of ideas.  And finally, as a great comedic mind once offered, “rights are the last resort of a [person] with no argument” and the Left’s call for “rights” ignore how often they are suspended in times of crisis or have never existed for large swaths of the planet’s populace.  This should be absolutely apparent to anyone who has been on the streets of a supposedly liberal Pacific Northwest city over the past few weeks, or has simply been observing.  Now, that we have considered how the Left views how the actual lives and deaths of working-class and poor peoples as externalities in formal ways, the maliciousness of their informal practices should be noted too.  

A self-serving and moralistic politics has dominated the Left as of late, where faux outrage meant to condemn the personal lifestyles and decisions of the target while holding one’s own personal lifestyles and decisions as morally superior.  Meaning, the illusion of choice and free will results in a working-class bartender being scolded by their middle-class customer, who is in the midst of guzzling down another twenty-dollar cocktail, for taking a cheaper Uber / Lyft home after a twelve hour shift rather than the more expensive local cab company.  Notions of self-care, GoFundMe campaigns for medical bills, Buzzfeed articles and similar lists given as commandments – “20 Books You Must Read this Year,” “6 ways to be antiracist, because being ‘not racist’ isn’t enough” – are individual solutions, often impossible ones, to what are social problems.  These developments are often coupled with a crises of representation and measure along with the disappearance of class as an operating category.  ‘Interlocking oppressions’ and ‘identity’ were to augment and complement class as “new measures of oppression and inequality,” to use the apt words of Keeanga-Yamahtta Taylor, rather than replace it.[10]  Or, in fact, it is the middle-class assumptions of the contemporary Left and radical forces that have placed various issues outside of, above, and primary to class because it allows the middle-class to claim legitimacy within a fundamentally unjust and undemocratic system at the expense of working-class and poor peoples.  It is as if the Left has forgotten that, “Immigrant issues, gender issues and antiracisms are working-class issues.”[11]  Nevertheless there are issues neighboring these too.              

Behind call outs, privilege politics, and reinvigorated essentialisms, one can hear the tired slogans: “Ho Ho Ho Chi Minh, the NLF is gonna win!” and “Fight the People!”  According to various factions that splintered the Students for a Democratic Society in 1969, of which the Weather Underground is the most pernicious, the American war in Vietnam was bad, so the Vietcong was good; politically conscious radicals were good, white working-class people were bad.  Purges, purity tests, self-criticism, or better off self-flagellation, immediately followed such recitations.  

Not then, and certainty not now, have such measures resulted in strong liberatory movements much less substantive, material or otherwise, gains for oppressed and working-class people.  Nor have movements themselves found transformative ways to address internalized oppression and behaviors, even with the gallant efforts led by women and trans people of color.  After fifty-years of such politics, one would think with the clearly observable historic defeat of Left and radical forces with the rise of incipient fascism other avenues would be explored, other ideas rediscovered and developed, other strategies and tactics deployed.  

In the streets many revolutionaries now call forth “fire from heaven,” not out of revenge or resentment but for our very survival.  Emile Zola was not so forgiving in Germinal: “There he stood with arms raised like an inspired prophet of old, calling down the wrath of God upon the murderers, foretelling the age of justice and the coming extermination of the bourgeoisie by fire from heaven, since it has committed the foulest crime of all and caused the workers and the penniless of the world to be slain.”[12]  Though, what is to be done when those who “caused the workers and the penniless of the world to be slain” are not just the political class, the bourgeoisie, Republican governors and liberal mayors but our fellow citizens?  Fellow citizens refusing to wear masks, coughing in the faces of essential workers and spitting on cashiers, setting up roadblocks to harass those fleeing wildfires, driving through crowds of protestors and arming themselves against their neighbors.  And, with particular vitriol, calling for and in some cases actively exterminating Black and Indigenous people of color, trans women of color, immigrant children, the elderly and infirm.  

As I have claimed herein, the Left not only lacks a concept of social change, it is entirely unprincipled.  But even without principles the Left is being educated nightly as it is struck over the head by police batons.  And the radical and revolutionary movements are discovering its principles and power in concert with thousands of others who have set the fires from heaven upon police stations. Banks, bosses, landlords will burn too.  

Where does one find prospects and possibilities within this plague?  Now, as always, in the new struggles that are emerging, and new social antagonisms being expressed.  As I sat down to write this it is the multitudinous mutual aid projects growing in barren landscapes, then those standing “with arms raised.”

For those of us who are radicals and revolutionaries, we will be called to do immoral things in this crisis. Immoral by the standards of the Left and progressive moralists and possibly immoral by our own standards.  It is clear that the Democratic Party establishment and Left which aligns itself with it has made peaceful revolution impossible.  Whereas the Left is more interested in its own self-preservation and defense of its position in the capitalist, white supremacist, heteronormative, settler colonial, property owning systems then a substantive redistribution of wealth, land, power.  Whereas much of the radical Left would rather confront each other over perceived slights than directly confront power and construct counterpowers.  Currently the streets of Portland, Chicago, New York along with the streets of rural towns are all bursting with protestors. They are refusing to delegate responsibility for their futures to agencies outside of themselves, to representatives and non-profits, to the so-called official organizations of the working-class.  However, now, rather than dying amongst strangers, thousands of unhoused, poor, women, trans and gender non-conforming people, people of color, Indigenous, immigrant, imprisoned, “others,” and militant accomplices who accompany them have chosen the possibility of death rather than certain death so that they may live. So that we all may live.

The Long Shadow of Racial Fascism

In the wake of the 2016 election, public intellectuals latched onto the new administration’s organic and ideological links with the alt- and far right. But a mass civic insurgency against racial terror—and the federal government’s authoritarian response—has pushed hitherto cloistered academic debates about fascism into the mainstream, with Peter E. GordonSamuel Moyn, and Sarah Churchwell taking to the pages of the New York Review of Books to hash out whether it is historically apt or politically useful to call Trump a fascist. The F-word has also been making unusual forays into CNN, the New York Times, and mainstream discourse. The increasing prospect that any transfer of power will be fraught—Trump has hinted he will not accept the results if he loses—has further intensified the stakes, with even the dependable neoliberal cheerleader Thomas Friedman conjuring up specters of civil war.

Notwithstanding the changing terrain, talk of fascism has generally stuck to the same groove, namely asking whether present phenomena are analogous to those familiar from interwar European dictatorships. Sceptics of comparison underscore the way in which the analogy of fascism can either treat the present moment as exceptional, papering over the history of distinctly American forms of authoritarianism, or, alternatively, be so broad as to fail to define what is unique about our current predicament. Analogy’s advocates point to the need to detect family resemblances with past despotisms before it’s too late, often making their case by advancing some ideal-typical checklist, whether in terms of the elements of or the steps toward fascism. But what if our talk of fascism were not dominated by the question of analogy?

Attending to the long history of Black radical thinking about fascism and anti-fascist resistance—to what Cedric Robinson called a “Black construction of fascism” alternative to the “historical manufacture of fascism as a negation of Western Geist”—could serve to dislodge the debate about fascism from the deadlock of analogy, providing the resources to confront our volatile interregnum.

Long before Nazi violence came to be conceived of as beyond analogy, Black radical thinkers sought to expand the historical and political imagination of an anti-fascist left. They detailed how what could seem, from a European or white vantage point, to be a radically new form of ideology and violence was, in fact, continuous with the history of colonial dispossession and racial slavery.

Pan-Africanist George Padmore, breaking with the Communist International over its failure to see the likenesses between “democratic” imperialism and fascism, would write in How Britain Rules Africa (1936) of settler-colonial racism as “the breeding-ground for the type of fascist mentality which is being let loose in Europe today.” He would go on to see in South Africa “the world’s classic Fascist state,” grounded on the “unity of race as against class.” Padmore’s “Colonial Fascism” thus anticipated Aimé Césaire’s memorable description of fascism as the boomerang effect of European imperialist violence.

African American anti-fascists shared the anti-colonial analysis that the Atlantic world’s history of racial violence belied the novelty of intra-European fascism. Speaking in Paris at the Second International Writers Congress in 1937, Langston Hughes declared: “We Negroes in America do not have to be told what fascism is in action. We know. Its theories of Nordic supremacy and economic suppression have long been realities to us.” It was an insight that certainly would not have surprised any reader of W. E. B. Du Bois’s monumental reckoning with the history of U.S. racial capitalism, Black Reconstruction in America (1935). As Amiri Baraka would suggest much later, building on Du Bois’s passing mentions of fascism, the overthrow of Reconstruction enacted a “racial fascism” that long predated Hitlerism in its use of racial terror, conscription of poor whites, and manipulation of (to quote the famous definition of fascism by Georgi Dimitrov) “the most reactionary, most chauvinistic, and most imperialist sector of finance capital.”

In this view, a U.S. racial fascism could go unremarked because it operated on the other side of the color line, just as colonial fascism took place far from the imperial metropole. As Bill V. Mullen and Christopher Vials have suggested in their vital The US Antifascism Reader (2020):

For people of color at various historical moments, the experience of racialization within a liberal democracy could have the valence of fascism. That is to say, while a fascist state and a white supremacist democracy have very different mechanisms of power, the experience of racialized rightlessness within a liberal democracy can make the distinction between it and fascism murky at the level of lived experience. For those racially cast aside outside of liberal democracy’s system of rights, the word ‘fascism’ does not always conjure up a distant and alien social order.

Or, as French writer Jean Genet observed on May 1, 1970, at a rally in New Haven for the liberation of Black Panther Party chairman Bobby Seale: “Another thing worries me: fascism. We often hear the Black Panther Party speak of fascism, and whites have difficulty accepting the word. That’s because whites have to make a great effort of imagination to understand that blacks live under an oppressive fascist regime.”

It was largely thanks to the Panthers that the term “fascism” returned to the forefront of radical discourse and activism in the late 1960s and early 1970s. The United Front Against Fascism conference held in Oakland in 1969 brought together a wide swathe of the Old and New Lefts, as well as Asian American, Chicano, Puerto Rican (Young Lords), and white Appalachian (Young Patriots Organization) activists who had developed their own perspectives on U.S. fascism—for instance, by foregrounding the experience of Japanese internment during World War II. In a striking indication of the peculiarities and continuities of U.S. anti-fascist traditions, among the chief planks of the conference was the notionally reformist demand for community or decentralized policing—to remove racist white officers from Black neighborhoods and exert local checks on law enforcement.

Political prisoners close to the Panthers theorized specifically about what we could call “late fascism” (by analogy with “late capitalism”) in the United States. At the same time that debates about “new fascisms” were polarizing radical debate across Europe, the writing and correspondence of Angela Y. Davis and George Jackson generated a theory of fascism from the lived experience of the violent nexus between the carceral state and racial capitalism. Davis, the Black Marxist and feminist scholar, needs little introduction, her 1970 imprisonment on trumped-up conspiracy charges having rocketed her to the status of household name in the United States and an icon of solidarity worldwide. Fewer remember that the conspiracy charge against Davis arose from an armed courtroom attack by her seventeen-year-old bodyguard, Jonathan Jackson, with the goal of forcing the release of the Soledad Brothers, three African American prisoners facing the death penalty for the killing of a white prison guard. Among them was Jonathan’s older brother, the incarcerated Black revolutionary George Jackson, with whom Davis corresponded extensively. Jackson was killed by a prison sniper during an escape attempt on August, 21, 1971, a few days before the Soledad Brothers were to be tried.

In one of his prison letters on fascism, posthumously collected in Blood in My Eye (1972), Jackson offered the following reflection:

When I am being interviewed by a member of the old guard and point to the concrete and steel, the tiny electronic listening device concealed in the vent, the phalanx of goons peeping in at us, his barely functional plastic tape-recorder that cost him a week’s labor, and point out that these are all manifestations of fascism, he will invariably attempt to refute me by defining fascism simply as an economic geo-political affair where only one party is allowed to exist aboveground and no opposition political activity is allowed.

Jackson encourages us to consider what happens to our conceptions of fascism if we take our bearings not from analogies with the European interwar scene, but instead from the materiality of the prison-industrial complex, from the “concrete and steel,” from the devices and personnel of surveillance and repression.

In their writing and correspondence, marked by interpretive differences alongside profound comradeship, Davis and Jackson identify the U.S. state as the site for a recombinant or even consummate form of fascism. Much of their writing is threaded through Marxist debates on the nature of monopoly capitalism, imperialism and capitalist crises, as well as, in Jackson’s case, an effort to revisit the classical historiography on fascism. On these grounds, Jackson and Davis stress the disanalogies between present forms of domination and European exemplars, but both assert the privileged vantage point provided by the view from within a prison-judicial system that could accurately be described as a racial state of terror.

This both echoes and departs from the Black radical theories of fascism, such as Padmore’s or Césaire’s, which emerged from the experience of the colonized. The new, U.S. fascism that Jackson and Davis strive to delineate is not an unwanted return from the “other scene” of colonial violence, but originates from liberal democracy itself. Indeed, it was a sense of the disavowed bonds between liberal and fascist forms of the state which, for Davis, was one of the great lessons passed on by Herbert Marcuse, whose grasp of this nexus in 1930s Germany allowed him to discern the fascist tendencies in the United States of his exile.

Both Davis and Jackson also stress the necessity to grasp fascism not as a static form but as a process, inflected by its political and economic contexts and conjunctures. Checklists, analogies, or ideal-types cannot do justice to the concrete history of fascism. Jackson writes of “the defects of trying to analyze a movement outside of its process and its sequential relationships. You gain only a discolored glimpse of a dead past.” He remarks that fascism “developed from nation to nation out of differing levels of traditionalist capitalism’s dilapidation.”

Where Jackson and Davis echo their European counterparts is in the idea that “new” fascisms cannot be understood without seeing them as responses to the insurgencies of the 1960s and early 1970s. For Jackson, fascism is fundamentally a counterrevolutionary form, as evidenced by the violence with which it represses any consequential threat to the state. But fascism does not react immediately against an ascendant revolutionary force; it is a kind of delayed counterrevolution, parasitic on the weakness or defeat of the anti-capitalist left, “the result of a revolutionary thrust that was weak and miscarried—a consciousness that was compromised.” Jackson argues that U.S.-style fascism is a kind of perfected form—all the more insidiously hegemonic because of the marriage of monopoly capital with the (racialized) trappings of liberal democracy. As he declared:

Fascism has established itself in a most disguised and efficient manner in this country. It feels so secure that the leaders allow us the luxury of a faint protest. Take protest too far, however, and they will show their other face. Doors will be kicked down in the night and machine-gun fire and buckshot will become the medium of exchange.

In Davis’s concurrent theorizing, the carceral, liberationist perspective on fascism has a different inflection. For Davis, fascism in the United States takes a preventive and incipient form. The terminology is adapted from Marcuse, who remarked, in an interview from 1970, “In the last ten to twenty years we’ve experienced a preventative counterrevolution to defend us against a feared revolution, which, however, has not taken place and doesn’t stand on the agenda at the moment.” Some of the elements of Marcuse’s analysis still resonate (particularly poignant, in the wake of Breonna Taylor’s murder by police, is his mention of no-knock warrants):

The question is whether fascism is taking over in the United States. If by that we understand the gradual or rapid abolition of the remnants of the constitutional state, the organization of paramilitary troops such as the Minutemen, and granting the police extraordinary legal powers such as the notorious no-knock law which does away with the inviolability of the home; if one looks at the court decisions of recent years; if one knows that special troops—so-called counterinsurgency corps—are being trained in the United States for possible civil war; if one looks at the almost direct censorship of the press, television and radio: then, as far as I’m concerned, one can speak with complete justification of an incipient fascism. . . . American fascism will probably be the first which comes to power by democratic means and with democratic support.

Davis was drawn to Marcuse’s contention that “fascism is the preventive counter-revolution to the socialist transformation of society” because of how it resonated with racialized communities and activists. In the experience of many Black radicals, the aspect of their revolutionary politics that most threatened the state was not the endorsement of armed struggle, but rather the “survival programs,” those enclaves of autonomous social reproduction facilitated by the Panthers and more broadly practiced by Black movements. While nominally mobilized against the threat of armed insurrection, the ultimate target of counterinsurgency were these experiments with social life outside and against the racial state—especially when they edged toward what Huey P. Newton named “revolutionary intercommunalism.”

What can be gleaned from Davis’s account is the way that fascism and democracy can be experienced very differently by different segments of the population. In this regard, Davis is attuned to the ways in which race and gender, alongside class, can determine how fascist the country seems to any given individual. As Davis puts it, fascism is “primarily restricted to the use of the law-enforcement-judicial-penal apparatus to arrest the overt and latent revolutionary trends among nationally oppressed people, tomorrow it may attack the working class en masse and eventually even moderate democrats.” But the latter are unlikely to fully perceive this phenomenon because of the manufactured invisibility of the site of the state’s maximally fascist presentation, namely, prisons with their “totalitarian aspirations.”

The kind of fascism diagnosed by Davis is a “protracted social process,” whose “growth and development are cancerous in nature.” We thus have the correlation in Davis’s analysis between, on the one hand, the prison as a racialized enclave or laboratory and, on the other, the fascist strategy of counterrevolution, which flow through society at large but are not experienced equally by everyone everywhere. As Davis has written more recently:

The dangerous and indeed fascistic trend toward progressively greater numbers of hidden, incarcerated human populations is itself rendered invisible. All that matters is the elimination of crime—and you get rid of crime by getting rid of people who, according to the prevailing racial common sense, are the most likely people to whom criminal acts will be attributed.

The lived experience of state violence by Black political prisoners such as Davis and Jackson grounded a theory of U.S. fascism and racial capitalism that interrupted what Robinson called the “euphonious recital of fascism” in mainstream political thought. It can still serve as an antidote to the lures and limits of the analogies that increasingly circulate in mainstream debate.

As the Black Lives Matter movement has made clear, the threat is not of a “return of the 1930s” but the ongoing fact of racialized state terror. This is the ever-present danger that animates present-day anti-fascist energies in the United States—and it cannot be boiled down to the necessary but insufficient task of confronting only those who self-identify as fascists.

Stuart Hall once castigated the British left for its passionate attachment to the frame of anti-fascism, for gravitating to the seemingly transparent battle against organized fascism while ignoring new modalities of authoritarianism. There were indeed fascists (the National Front), but Thatcherism was not a fascism. Conversely, Davis and Jackson glimpsed a fascist process that didn’t need fascists. Fascists without fascism, or fascism without fascists—do we have to choose?

To bridge this antinomy, we need to reflect on the connection between the features of “incipient fascism”—in the U.S. case, the normalization of forms of racial terror and oppression—and the emergence of explicitly fascist movements and ideologies. We need to think about the links between the often extreme levels of classed and racialized violence that accompany actually-existing liberal democracies (think, for instance, of the anti-migrant militarization of the U.S. and E.U. borders) and the emergence of movements that espouse a host of extreme positions that invert this reality: these include the belief that the state and culture have been occupied by the “radical” left (by “Cultural Marxism,” by critical race theory), that racism is now meted out against formerly dominant ethnic majorities, and that deracinated elites have conspired with the wretched of the earth to destroy properly “national” populations that can only be rescued by a revanchist politics of security and protectionism.

Our “late” fascism is an ideology of crisis and decline. It depends, in the words of abolitionist scholar Ruth Wilson Gilmore, on enlisting supporters on the basis of “the idea and enactment of winning, of explicit domination set against the local reality of decreasing family wealth, fear of unemployment, threat of homelessness, and increased likelihood of early, painful death from capitalism’s many toxicities.” Its psychological wages and racial dividends do considerable political economic work, perpetuating a brutally unequal regime of accumulation by enlisting bodies and psyches into endless culture wars.

But what is this late fascism trying to prevent? Here is where the superstructure sometimes seems to overwhelm the base, as though forces and fantasies once functional to the reproduction of a dominant class and racial order have now attained a kind of autonomy. No imminent threat to the reproduction of capitalism is on the horizon (at least no external one), so that contemporary fascist trends manifest the strange spectacle of what, in a variation on Davis and Marcuse, we could call a preventive counterreform. This politics is parasitic, among other things, on resuscitating the racialized anti-communism of a previous era, now weaponizing it against improbable targets such as Kamala Harris, while treating any mildly progressive policy as the harbinger of the imminent abolition of all things American, not least the suburbs.

But, drawing on the archive of Black radical theories of fascism, we can also start to see the present in a much longer historical arc, one marked by the periodic recurrence of racial fascism as the mode of reaction to any instance of what Du Bois once called “abolition democracy,” whether against the First Reconstruction, the Second Reconstruction, or what some have begun, hopefully, to identify as the Third.

Hitler Is Not Dead: On Bourgeois Electoralism, Liberalism as the Left Wing of Fascism, and the Politics of Exceptionalizing Donald Trump

We are in a sociopolitical moment where it is arguably more crucial than ever to challenge widespread, and often deliberate, misapprehensions regarding historical precedents, to avoid remaking past mistakes and repeating history when so much is at stake. Fascism is a socio-economic and political project and system of governing that began the moment Europeans first made contact with West African shores. The process continued when the Euro-American bourgeoisie further invaded Indigenous territory in conquest for expanding markets and sources of capital, and marked the creation of what we know today as America—the most powerful and technologically advanced hyper-militarized carceral-police state and exporter of capitalist, imperialist, and colonial violence and domination that the world has ever seen. The consequential violence and contradictions that have been exposed the last four years, which by many have been attributed solely to Donald Trump and co., are simply the demands and material consequences of capital and white supremacy (which go hand-in-hand, and are essentially inseparable). The exceptionalizing of Trump or his administration is short-sighted and dangerous. In reality, any US president would be tasked with such a role and responsibility.

Yet, what the liberal media apparatus and ruling class has spent the last four years doing to Trump—much like the West has historically done to Hitler—making him out to be an ‘exceptional’ evil, unlike anything we’ve ever seen before, as a means of separating themselves from (what is largely described as exclusively Trumpian or Hitlerian) political crimes, represents an incredibly grotesque and ahistorical deliberation on the part of the elite. In other words, Hitler was not the first Hitler and Trump is not the first Trump. And they certainly won’t be the last. Trump, just as Hitler was, is not the exception but the rule of what white-supremacist-patriarchal capitalism is capable of, and what this system is willing to do (or produce) to maintain its naturalized order and rule. And if we allow them to continue to exceptionalize what Trump is doing, or has done up until this point—even if he’s doing it in unorthodox ways—we will be bamboozled yet again as yet another, more effective, less blatant Trump will inevitably rise.

What Hitler did, and what Trump is currently doing—as in their (racialized) political, economic, and war crimes—are not exclusive or unique to either of them as individuals, despite what Western (revisionist) history and the professional liberal media class would like to have us believe. But instead, racial terror, violence, and genocide, is and always has been the point of the Western (and American) project. It is built into the fabric of the of the West—it is all Euro-American’s have ever known, culturally and politically. And they will, as we have seen, continue their terror and violence because the political economy is sustained on such; until the entire project is brought to a halt. The global capitalist political economy is predicated on and sustained through racialized violence, and cannot be attributed solely to any one individual leader or figurehead. When I say that Hitler, or Trump in this case, are not exceptional evils, despite both being individually evil and worthy of our condemnation: it is to say that every western leader—namely in the context of US presidents—has blood on their hands. And all have, both individually and collectively, terrorized and massacred countless people, as their policies and upholding of US hegemony, by means of imperialism, [neo]colonialism, and global capitalism, has directly and indirectly led to such deadly consequences.

When I switch on my radio and hear that Jews are being insulted, persecuted, and massacred, I say that they have lied to us: Hitler isn’t dead. And finally when I switch on my radio and hear that in Africa forced labor has been introduced and legalized, I say that truly they have lied to us: Hitler isn’t dead.”

I would like to preface the rest of this by stating that when I speak of Hitler, it is not just in the context of the individual—but an idea, as Aimé Césaire would describe it, both abstract and material, that is innate to western civilization and the maintenance of the regime which has global implications. Hitler was, quite literally on record, inspired by the United States’ treatment of Black and Indigenous people in America. But, the US, and the West at-large, has exceptionalized him, as if they are morally and politically above his crimes. How is what Hitler, and now Trump, did and are actively doing so unspeakable to the professional liberal apparatus, when such crimes have always been committed against racialized people on a global scale? How can we take seriously the largely performative outrage and condemnation that the Hitlers or Trumps of our world have incited in liberals when similar crimes have been enacted on racialized persons on a global scale by political leaders such as Winston Churchill, Franklin D. Roosevelt, Harry Truman, John F. Kennedy, and Barack Obama, all of whom they admire? What is Hitler to the African, whose enslavement, rape, theft, dispossession, and exploitation served as a template for what would be exported to other colonized nations and peoples for the purposes and demands of Western capital? What is Hitler to the Palestinian whose terror and ongoing genocide is being supported and funded by the US (and every single one of our politicians)? What is Hitler to the Iranian, Korean, or Chinese whose subjugated positionality is that of the result of US imperialism and global capitalism? What is Hitler to any racialized, imperialized, or colonized nation or peoples who have reaped the consequences of Euro-American capital and rule?

And now the Iranians and other people like that. Europe had nothing against Hitler and neither did [America] until he turned his guns against them.”

Fascism is not something that can be simply born or defeated via electoralism—in countries that are capitalist, colonialist, and/or imperialist from their inception, as was such in the case of the US and Germany. An able and willing fascist participant can absolutely run for office, uphold such an order, and maybe even advance it in a wide variety of ways. But there has not been a case in which fascism begins or ends with said individual or political act of simply voting. So while yes, the ruling class technically “allows” its subjects the illusive option to vote for and “elect” (with conditions, of course) whomever will be the upholder of said system, it is the system itself — that makes way for the empowerment and upholding of individuals, ideologies, and violence—that needs undoing, not just the figurehead representing it. Which, again, is what makes it ncessary to expose the liberal exceptionalizing of Trump’s regime of violence—because the capitalist ruling class will easily relieve Trump of his duties of upholding the white-supremacist fascist order and replace him with someone who will effectively maintain the white power structure with grace and class, just as liberals like it, in a way that is socially acceptable to the vast majority of American people (and the West at large). Because the vast majority of Americans are simply unaware of the extent to which political violence is exported globally. And the amount of violence, terror, and death that elected leaders—from the self-proclaimed progressives to the unabashed neo-conservatives—are directly responsible for.

To reiterate, the inevitable ascension into the fascist order began when Europeans set foot on the shores of West Africa—not the 2016 general election in the US. Germany, for example, alongside the Euro-Americas, enslaved and massacred Africans with impunity centuries prior to the unfortunate birth of Hitler, the individual, and yet we are to believe fascism began with Hitler? Or, in the American sense, with Trump in 2016? Despite the incessant crimes of capital, which as we know, as Marx taught us, “[came] dripping from head to foot, from every pore, with blood and dirt” throughout history, including such crimes that birthed the bastard child of Europe now known as America? If it took multi-country war and an immeasurable amount of bloodshed led by the USSR to defeat the fascist beast in Germany—never mind the reluctance on the part of the US to get involved until Germany threatened US hegemony with its prospects of expanding its rule on a global scale—how are we supposed to believe that fascism is something to be defeated by merely checking off a box?

America was born as a nation, as an ideological extension of a European bourgeois political, cultural, and libidinal desire to expand new markets to generate more capital—even if it meant resorting to the utmost diabolical means. Hitler is not dead. As the US's values, institutions, global legitimacy, and grip on the world—namely the colonized world—is in decay, there is far too much evidence of just this fact. And everything we are seeing that the professional liberal class has duplicitously yet meticulously attributed solely to Trump and his ilk, whether in reference to the political repression happening across the country on the part of the carceral police state, the neglect of millions of citizens in a midst of a global pandemic and economic turmoil, or the hypervisibility of armed white militia groups, is simply a product of white-supremacist capitalism and its reaction to, and delaying, its inevitable demise.

The state at-large, and its upholders—whether in the form of the institutionalized agents or vigilantes—is reacting to the desires and needs of capital and whiteness. And regardless of who is president, these contradictions will continue to rise in these times because the needs of capital and whiteness largely come at the expense of the non-white and super-exploited, rendering it unsustainable and almost always in a constant state of flux and turmoil, and constantly in need of protection and adaptation. Hitler is not dead.

“We must resign ourselves to the inevitable and say to ourselves, once and for all, that the bourgeoisie is condemned to become every day more snarling, more openly ferocious, more shameless, more summarily barbarous; that it is an implacable law that every decadent class finds itself turned into a receptacle into which there flow all the dirty waters of history; that it is a universal law that before it disappears every class must first disgrace itself completely, on all fronts, and that it is with their heads buried in the dunghill that dying societies utter their swan songs.”

Fascism—as well as the personification of such in the form of Hitler and Trump—is the inevitable outcome of a global capitalist system whose entire economy is predicated on constant racialized war, terror, and violence, and unsustainably expanding and creating new markets to achieve such a feat. Hitler is not dead. Fascism is simply “capitalism in decay.” If we want to end, or even remotely challenge fascism, we must work to eradicate capitalism.

The misunderstanding of fascism begins with the deliberate political positing of [neo]liberalism as in-opposition or an alternative to the fascist order. When in actuality, history has shown us that it is in cahoots with, if not, an actual strand of fascism in and of itself. Liberal democrats often spout rhetorical devices such as, “there is no middle ground; pick a side.” Such statements are not to emphasize the crucial sociopolitical moment we find ourselves in, which necessitates that we choose between fascism or socialism—in the face of pending climate doom and deteriorating material conditions—but to guilt us into voting for Democrats over Republicans.

It has never been more apparent that liberal democrats are the stabilizers and upkeepers of fascist rule—who exist to provide an illusion of “opposition” to the material actualities and consequences of liberal democracy, western capital(ism), and the white power structure at-large—while actively upholding the neoliberal fascist order and inhibiting even the slightest possibilities of progress. Left radicals, or anyone who has divested from bourgeois electoralism, are constantly punched down on and condescended to for daring to demand more than mild concessions (“reforms” that’ll just be poked, prodded, weakened and rendered obsolete the moment the next Republican gets into office) and milquetoast, uninspiring, career-imperialist Democrat candidates. There have been constant claims on the part of liberal democrats—and those sympathetic to their politics—of radicals being “child-like” and expecting “purity” for wanting a world without constant racialized violence, demanding political representatives that aren’t subservient to capital but to our material interests, and refusing to engage in lesser of two evils every election cycle. It is quite clear that liberal establishment democrats—and the opportunists who serve their rule—are categorically irrelevant to the dispossessed, colonized, racialized, super-exploited, and wretched of our world, beyond their attempts to postpone and/or flat-out hinder our drive to build a better world, and redirecting our aims back into the arms of the establishment.

Liberal democrats obediently assume their role as the “left-wing” of fascism—the “good cops” to the Republican “bad cops.” The covert fascists versus overt fascists. But at the detriment to us all, the fact still remains that they are both still cops and they are both still driving a fascist system to its inevitable conclusion. Democrats represent the only publicly legitimized and acknowledged political “left” party despite being overwhelmingly ideologically right wing. They allow and endorse mild concessions that will help keep the racialized, colonized, dispossessed, and super-exploited slightly comfortable enough—at the expense of one another and persons in the Global South and Third World—to remain complicit in their subjugation. They will even give impassioned monologues on social media, or in front of the cameras, yell at Republicans’ blatant political violence—while doing nothing materially to actually offer resistance or represent an opposition to said violence beyond rhetorical moral grandstanding. While Republicans don’t even pretend to care about providing subjects of their rule crumbs through these concessions. They don’t pretend to care about whether or not you vote because they accept and relish in their bad cop role. But ultimately, both parties truly cannot exist and flourish without one another. They are both incredibly useful, in their own way, as agents of capital, to the sustainment and growth of fascism.

I’d argue “centrism,” “conservatism,” and “republicanism” are not even economic ideologies—in fact, their ideology largely rests on the premise that they have none—beyond the rule of capital. So why else—beyond the aforementioned reasons—would you need two parties? Both parties are one in the same—just differ in tactics and approaches—but are united under the banner of upholding economic [neo]liberalism, i.e., capitalism. Which is why the rhetoric of “we have a choice between neoliberalism or fascism”—which has been an ostensible liberal talking point—as if, again, neoliberalism is, or could ever be, an alternative, reprieve, or in-opposition to fascism. How could something that has historically worked in cahoots with fascism be an alternative to its rule?

The fact that so much state-sanctioned violence, political repression, mishandling and neglect of the most marginalized—especially incarcerated, immigrant, and houseless populations—in the face of COVID-19, an ongoing housing crisis, unemployment, and economic turmoil, is happening in “liberal” cities and cities led by Democrats nationwide, should very much inform our understanding of the situation at hand. The fascist order will remain intact regardless of who is elected into office on November 3rd—despite the hand-wringing and finger-pointing over which party is more at fault for white-supremacist capitalism’s ills being exposed. The public perception and liberal media coverage of certain events and political violence will adjust accordingly. What we are seeing now, and have been seeing for the last four years is simply a declining empire doing anything and everything it can to maintain its tight (but loosening) grip on its own people—as well as the rest of the world. As evidenced by not just the uprisings and rebellions happening across the country and the world at-large, but the failed coup d’etat attempts—namely in Venezuela and Bolivia—which the professional liberals condemned, not from an anti-imperialist stance but because of Trump’s inability to do imperialism effectively.

If Trump is Hitler, what is Obama to people of Libya? Or Syria? Or Pakistan? What is George W. Bush Jr. to Iraqis? What is Bill Clinton to the people of Sudan? Yuglosavia? What are any and all of them to migrants who have been caged and deported, or Black people who have been executed by police in the streets on a daily basis, or workers who have been left without means to sustain basic life, or tens of millions who are surveilled each and every day? These things occurred long before Trump and will continue to escalate long after Trump.

The empire lives. For now. And Hitler is not dead.

The FBI's War on the Left: A Short History of COINTELPRO

Throughout its history the United States has billed itself as an open society upholding the free exchange of ideas. We are told that, unlike people in less-enlightened countries, Americans do not have to worry about being persecuted for their political beliefs. Of course, this has never been true. From its very inception, the US government has been restricting free-speech through legislation such as the Alien and Sedition Act of 1798- not to mention the restriction on expression for the enslaved. Americans usually consider this a thing of the past, but political repression continued throughout the 20th century to this day, but in more covert forms. In this essay, I will explore the historical development of the US government’s system of covert domestic political repression, its consolidation, and its culmination in the FBI’s COINTELPRO program.

The FBI has its origins in the General Intelligence Division which was created in 1919 by Attorney General A. Mitchell Palmer to collect information on radical organizations. J. Edgar Hoover, who would remain in power for the next several decades, was appointed as its head.[1] The GID was immediately used in the infamous Palmer Raids- a series of mass arrests and deportations targeting “alien” members of radical movements. The raids began on November 7, 1919 when GID agents raided offices of the United Russian Workers across the country arresting 650 people and deporting at least 43 without due process.  The crescendo of the raids came on January 2, 1920 when GID agents descended on radical groups in over 30 cities across the country, arresting at least 3,000 people.[2] Much of this repression was directed at the Communist Party USA, with Secretary of Labor William B. Wilson announcing on January 19th that membership in the CPUSA was enough to warrant deportation of immigrants.[3] The raids were finally ended by a court ruling in June 1920, but by then the damage had already been done. Left-wing organizations were effectively decimated with Communist Party membership dropping from over 27,000 in 1919 to just over 8,000 the next year.[4]

Along with the Palmer raids, the Bureau utilized numerous other methods to harass radical groups. In 1919, Hoover targeted Marcus Garvey’s Universal Negro Improvement Association. The Bureau employed several infiltrators in the UNIA to uncover information which could be used in trumped up criminal charges against Garvey. After numerous charges of criminal activity failed to stick, the Bureau managed to obtain a conviction against Garvey on mail fraud in 1925. He was deported to Jamaica in 1927.[5]

By the mid-1920s, Hoover was able to renounce the FBI’s past political operations. Aside from participating in repression of major strikes, the Bureau would be true to its word for the next decade. But as the Communist Party began to regain relevance- reaching 66,000 members by 1939- Hoover gained approval from President Roosevelt to resume repression of “subversive activities”. Although Roosevelt later altered this directive as the Soviet Union became a key ally in the fight against Nazi Germany, it would not prevent Hoover from using it as justification for later counter-intelligence activities.[6]

After World War II ended and the Cold War began, Communism became enemy #1 with the CP becoming a natural target. In coordination with the CIA, the FBI began a program of intercepting and inspecting the international communications of US citizens. This was particularly focused on the mail and cables between the US and Soviet Union.[7] Additionally, the Bureau would frequently use other forms of information gathering such as “surreptitious entry” and “bugging” CP offices.[8] The FBI also cooperated with the IRS to gather information on targeted groups and single them out for harassment from the IRS.[9]

Additionally, the FBI would perfect the divide and conquer techniques it would later use to great effect in official COINTELPRO programs against the CP. The Bureau used infiltrators to exploit internal divisions within the party, such as over Khrushchev’s denunciations of Stalin.[10] The Bureau also used “anonymous mailings” in various ways to disrupt party activities. Agents would send letters to party members warning about the treacherous activities of others in the party, hoping to stir up factional disputes.[11] This was also a common ploy in the FBI’s “snitch jacketing” technique to portray loyal party members as informants. This was also frequently accomplished by informants within the party spreading rumors, forged informant reports, or “interviews” where agents would publicly speak with a target to create the impression the party member was an informant.[12]

Anonymous letters and interviews would also be used to impact the personal lives of party members or disrupt alliances the party would make with other groups. Agents would contact the employers or landlords of party members in efforts to get them fired or evicted. Additionally, if the CP were seeking to cooperate with other organizations, agents would send derogatory information to these organizations to prevent an alliance.[13]

These were the FBI’s covert methods in the battle against domestic communism, but it also played a direct role in the overt repression. The FBI played an active role in the rise of McCarthyism by cultivating “friendly media” outlets which would be used to disseminate derogatory information about the CP. Further, the Bureau aided anti-Communist private organizations such as the American Legion and anti-Communist congressmen, with FBI agents even writing their speeches.[14]

These activities would create a general context for the US government’s legal attacks against the CP leadership. FBI agents would use selective law enforcement to harass the party and its members. Party members were frequently arrested for minor or spurious causes. For example, a secretary of the Alabama branch of the CP was arrested and convicted of possessing “seditious literature” for carrying copies of The Nation and The New Republic. He was sentenced to 100 days hard labor and fined $100.[15] This culminated in the government’s use of the Smith Act to prosecute Communist Party members. The Smith Act was passed in 1940 and created criminal penalties for advocating the forcible overthrow of the US government and required all adult non-citizen residents to register with the federal government. It would be used to prosecute eleven top Communist Party members in 1949. All eleven were convicted with ten being sentenced to five to ten years and one- a World War II veteran- sentenced to three.[16] Similar cases would occur across the country, with frequent FBI interference in the judicial process.[17]

The official COINTELPRO program would not begin until 1956, although this was just a formalization of already existing FBI practices. Even though the Communist Party had already been decimated by the mid-1950s, the majority of COINTELPRO operations were carried out against the party. However, the most impactful COINTELPRO activities in this period were against other left-wing and civil rights movements. Some of the groups targeted were called “Black Extremist” groups. The Nation of Islam was an early target of this program, with the FBI maintaining massive files on just Elijah Muhammad and Malcolm X. The FBI would go on to play a role in driving a wedge between the two.[18]

As would become a habit for the FBI, the parameters for which groups qualified as “Black Extremists” was expansive. Organizations that would eventually come under the COINTELPRO purview included the NAACP, SCLC, and SNCC.[19] The FBI infamously wiretapped Martin Luther King Jr. and sent him anonymous letters encouraging him to commit suicide.[20]
COINTELPRO would reach its zenith in the late 60ss and early 70s with the inauguration of COINTELPRO-Black Panther and COINTELPRO-New Left. As with its counterintelligence activities against the CP, the Bureau’s tactics ranged from the petty to the outright murderous. Bureau infiltrators of New Left student organizations were instructed to uncover evidence of members’ “depravity” to be publicized.[21] Agents would even contact targets’ parents to inform them of their child’s subversive activities. The FBI also sought to prevent these groups from exercising their first amendment rights by preventing speaking events and public demonstrations. Further, given that many of these groups were popular on college campuses, the Bureau targeted academics friendly to radical groups, seeking to get them disciplined or fired.[22]
The Bureau also attempted to instigate violence between target groups and violence-prone rival political organizations or criminal organizations. In 1968, FBI Director J. Edgar Hoover sent a memorandum to FBI field offices instructing them to devise plans to exploit the conflict between the Black Panther Party and Ron Karenga’s Black Nationalist “US” organization.[23]

This was accomplished through infiltrators, anonymous mailings, and forged propaganda. For instance, the Los Angeles field office responded to Hoover’s call for proposals reporting:[24]

“The Los Angeles Office is currently preparing an anonymous letter for Bureau approval which will be sent to the Los Angeles Black Panther Party supposedly from a member of the ‘US’ organization in which it will be stated the youth group of the ‘US’ organization is aware of the [Black Panther Party] ‘contract’ to kill RON KARENGA, leader of ‘US’, and they, ‘Us’ members, in retaliation have made plans to ambush leaders of the [Party] in Los Angeles. It is hoped this counterintelligence measure will result in an ‘US’ and [Black Panther Party] vendetta.”

Agents also distributed forged propaganda meant to increase tensions between the BPP and US, such as this cartoon attributed to US:[25]

This strategy would bear fruits as hostilities between the two groups spilled over into violent confrontations resulting in the deaths of four BPP members, including prominent members John Huggins and Bunchy Carter. Despite Bureau protestations that it never intended to encourage violence, the FBI continued to encourage hostility between the two groups even after these killings. This is illustrated by a 1970 report from the FBI’s Los Angeles office:[26]

“Information received from local sources indicate that, in general, the membership of the Los Angeles BPP is physically afraid of US members and take premeditated precautions to avoid confrontations.

In view of their anxieties, it is not presently felt that the Los Angeles BPP can be prompted into what could result in an internecine struggle between the two organizations…

The Los Angeles Division is aware of the mutually hostile feelings harbored between the organizations and the first opportunity to capitalize on the situation will be maximized. It is intended that US Inc. will be appropriately and discreetly advised of the time and location of BPP activities in order that the two organizations might be brought together and thus grant nature the opportunity to take her due course.”

The Bureau used a similar technique with Operation Hoodwink, where the Bureau attempted to spark conflict between the Communist Party and the criminal organization La Cosa Nostra, as well as criminal elements within reaction unions such as the Teamsters. Fortunately, this attempt did not lead to any reported physical conflicts.[27] [28]

Additionally, the FBI liked to use a specific form of infiltrator known as “Agents Provocateurs” who would encourage members to commit violent or criminal acts. For example, a member of the Weather Underground arrested for a conspiracy to bomb Detroit police facilities was actually an FBI informant, Larry Grathwohl. Grathwohl reportedly instructed members on how to build bombs and participated in the group’s bombing of a Cincinnati public school.[29] One of the most famous provocateurs was “Tommy the Travler” Tongyai who traveled around college campuses in the northeast encouraging students to bomb military research facilities.[30]

As they did with the CP, the Bureau cooperated with local law enforcement to harass targeted groups and their members. Officials sought to stop targets frequently, hoping to arrest and convict them on minor charges. They would also attempt to frame targets for crimes they did not commit. This is exemplified by the case of Geronimo Pratt- a prominent member of the Los Angeles branch of the BPP. After numerous attempts to convict Pratt on trumped up charges failed, Pratt was accused of the 1968 “Tennis Court Murder”. On December 18, 1968, a white couple, Caroline and Kenneth Olsen, were robbed and shot by two black men on a tennis court in Santa Monica, California. Caroline Olsen would die a week later. In August 1969, an anonymous letter was delivered to the Los Angeles Police Department claiming Pratt had committed the murder and had been bragging about it. Pratt was also positively identified by Kenneth Olsen, leading to Pratt’s arrest and eventual conviction in 1972. Of course, the FBI was heavily involved in the trial. The anonymous letter turns out to have been written by Julius Butler, an FBI infiltrator, who would become a key prosecution witness. Additionally, the Bureau had at least one infiltrator in Pratt’s defense team keeping the Bureau informed on defense strategy. And the prosecution concealed the fact that Kenneth Olsen had initially identified another man, Ronald Perkins, as his wife’s killer and that police had purposefully influenced his identification. Pratt would remain in jail for a crime he did not commit until 1997 when his case was invalidated due to the prosecution’s suppression of evidence.[31]

But the worst of COINTELPRO was the Bureau’s use of violent raids and political assassinations. On April 6, 1968 a group of Panthers were confronted by police officers in west Oakland. Gunfire was exchanged and the police cordoned off the block. After an hour and a half, the Panthers attempted to surrender, but when unarmed ‘Lil Bobby Hutton emerged from a nearby basement, he was shot dead by police officers.[32] In a more overt case, Chicago police officers, with the assistance of the FBI, assassinated Fred Hampton in 1969. They were assisted by an FBI infiltrator, William O’Neal, who provided detailed floor plans of Hampton’s apartment.[33]

This is far from an exhaustive exploration of the FBI’s counterintelligence programs. The FBI targeted numerous groups such as the Socialist Workers’ Party, American Indian Movement, etc. that I was unable to cover here. While COINTELPRO was brought to light by the Church Committee in the 1970s and, subsequently, formally ended, the FBI has definitely continued its counterintelligence activities. In recent years, it has been revealed that the FBI maintains a list of “Black Identity Extremists”.[34] With this in mind, I think it is incredibly important for leftists to learn the history of COINTELPRO. With this knowledge we can more thoroughly safeguard our organizations against the inevitability of government subversion

As Usual, Most Of Us Miss The Point on Ice Cube and His "Platinum Plan"

Rapper/actor/entertainer Ice Cube has worn many hats throughout his professional career.  He started as a so-called gangsta rapper with the impactful group NWA in the late 80s.  Then, he joined forces with Dr. Khalid Abdul Muhammad and the Nation of Islam to become a hardcore Black nationalist rapper in the early 90s.  That phase devolved into him making several high profile records with Mac 10 and WC as the “Westside Connection.”  Records that were part gangsta, part party animal.  Finally, he moved into mainstream motion pictures.

Most recently, he rotated back into the struggle for African self-determination with many public statements supporting protests against police terrorism.  And, in the last several days, its been exposed that he worked, at least on some level, with the administration of the current empire president to help create and/or support the regime’s so-called “Platinum Plan.”  The alleged purpose of this plan is to supposedly uplift the African community within the U.S. with more promises of capitalist advancement for the African masses. 

Most Africans are attacking Ice Cube for working with Trump’s people, but this is an understandable yet extremely subjective and superficial analysis of the real issues here.  What most Africans, and everyone else, will refuse to do is actually study this so-called Platinum Plan.  Most of us will instead rely on sound bites from the capitalist media and celebrity culture.  Most of us will never actually read and assess the plan itself. 

And, studying this plan, and any plan that is supposed to improve the conditions of the African masses, at the very least, requires us to study it in great detail so that’s exactly what we will do here because whether its Ice Cube or Mickey Mouse, our people have to develop increased political sophistication so that we can read through the lines and properly understand what’s being beamed at us.  This is particularly important when you are talking about the Democratic or Republican Parties, both of whom Malcolm X beautifully exposed for us over 50 years ago, although most of us will never study his analysis as well.

You all need to study this so-called plan.  The basis of it is promises to provide three million new jobs for African people.  To create 500,000 African owned businesses by increasing capital in African communities.  A promise of $500 billion in capital.  Higher policing standards (whatever that is supposed to mean).  A Second Step program which is supposed to address criminal justice system reform “while ensuring our communities and streets are safe.”  There are other statements about support for African churches, immigration policies that protect U.S. jobs, and healthcare.

Let’s break down each element here. 

Three million new jobs:  You have the last four years to provide ample evidence for how this regime, (and all the other ones to – we are neither Democrats, nor Republicans, nor Americans) manipulates employment data.  For them, millions of new jobs that pay minimum wage, offer no benefits, and have no job protections is a bragging right.  The truth is there is no where in this country where quality jobs defined as livable wages, affordable healthcare, and safe work conditions are increasing.  What is increasing are service jobs with low wages, no healthcare, and no stability.  These types of jobs serve the economic interests of the bourgeoisie like Trump and he and those in his class have a history of creating these types of low level jobs.  Anyone with even a cursory perspective on this question would understand clearly that the jobs these people are talking about creating will do nothing to improve the collective conditions of African people.

500,000 new African businesses and $500 billion in capital: Whenever a plausible suggestion for providing healthcare for people or rehabilitation efforts, eliminating houselessness, etc., there is immediately an outcry from reactionaries demanding to know “where the money will come from?”  Yet, some of you believe that this level of capital will be invested in African communities to permit us to independently develop.  A quick study of history will reveal to us that this concept, and all these bogus concepts in this so-called plan, are not new.  In the 1960s, in response to hundreds of urban rebellions, the Nixon administration with the support of McGeorge Bundy and the Chevron Foundation, wrote the script for Affirmative Action as a vehicle to create an African petti bourgeoisie that would have class interests that led it to protect the capitalist system.  This was accomplished.  And with that accomplishment its important to recognize that the goal of Nixon, Bundy, Rockefeller and all those folks 50+ years ago was never to uplift the African masses, although that’s the same rhetoric they used then.  It was to do exactly what they did, create an overseer class of Africans.  Today, even if you believe the numbers they are committing to, this is still their objective.  Whether we recognize it or not, the level of mass protests always rock the capitalist ruling classes to their knees.  They will always do whatever possible to control and mitigate that militancy.  Expanding the African petti bourgeoisie is again their answer.  The question you have to ask yourself is if after 50 years ago, there is no clear pathway for the masses of our people to advance through this model, why would you believe this go around will be any different?

Criminal Justice Reform, etc.:  By reform if you mean reducing the systemic inequities in this racist system (and if reform doesn’t mean that then what’s the point), you are living in a fantasy world if you actually believe this plan is going to make that happen.  This mass incarceration system is based on the same exploitative model that built capitalism.  Releasing a handful of people is great because they all need to be released, but as long as there is a capitalist system, there will be people incarcerated on a mass scale and the overwhelming majority of those people are going to be African and Indigenous.  Also, this talk about protecting and keeping jobs in the U.S. is laughable.  These people want you to believe that poor immigrants are the reason jobs are not available.  The truth is corporations have benefitted from the North Atlantic Free Trade Agreement (NAFTA) and other trade tariff agreements to move their operations overseas because its more profitable for them to do that.  The capitalist assault against organized labor along with the refusal of unions to embrace actual political education, has weakened unions and made them revenue motivated entities.  This has done more to create conditions where jobs can leave this economy than anything else and the crafters of this so-called plan are 100% in favor of gutting unions which leaves no voice and protection for workers.

We can go on and on, but the point is this issue is so much bigger than Ice Cube.  This is a question of our lack of political sophistication and our weakness in accepting any random capitalist approved celebrity as our mouthpiece for advancing our people.  When we do this we continue to demonstrate how easily we are willing to be chumped by this system.  Some of us want these things to happen because we are really just concerned about our individual ability to get ahold of some of those dollars that could potentially be invested so that we can build upon our personal business, etc., desires.  These people should be viewed as parasites on our people no different than pimps, drug dealers, etc.  For those of us concerned about the masses of our people, we know that no capitalist plan is ever going to be the solution.  If that was true, it would have happened a long time ago.  Stop looking to celebrities and everyone else to be our voice.  That has simply never worked for us.  Until you see this as your responsibility to get involved and get serious about understanding these issues on deeper levels than the superficial basis we are talking about them now, we will continue to be political chump footballs for everybody who has access to the glitter and lights this system provides to them at your expense.
